We were terminated on our MSA with a general for convenience, the owner had another company he wanted to do the work. We are halfway through the project located on a mountain in a ski resort. We were the excavation company for this project. We have been installing large retaining walls, utility lines, and foundations for a condo project. We have been asked to refund the portion of the deposit we are still holding. Is there any way to protect us from any further warranties on this job since we did not get to finish it? Should we remove this general contractor as an additional insured from the day we left the job from our insurance? Or do we leave them as additional insured? ...Read More

I have completed a home renovation project using a general contractor. The contractor used subcontractors. I will have a meeting to make a final payment. At that meeting, I want an unconditional release from the contractor for all claims, liens etc. by the Contractor AND any subcontractor or materials providers the Contractor used on the project. Does your North Carolina form "Unconditional Waiver and Release on Final Payment" accomplish that objective? Thank you. Hal Murry (hal.murry@gmail.com)...Read More

Hi. I was wondering, If I start an apprenticeship with a non-union affiliated construction business and complete my apprenticeship and then apply for carpentry license, will the apprenticeship (4 years) count towards experience for my general contractor license? Or does it only count if it is certified by the union? Thank you in advance....Read More

I’ve searched different websites and still can’t find an answer. I’m a California general contractor and a subcontractor (cabinet maker) is asking for a 10% deposit ($10k) and wants progress payments while they are fabricating the cabinets. Since I, as a GC, can’t ask for progress payments without materials on the jobsite, can a subcontractor? Thanks in advance! John Rising 415-342-3066...Read More

Hello, I am schedule to replace the roof of a hotel. I submitted my contract and the owners requested that we only sign a detailed PO. My only concern is that the terms I have in my contract wont be on the PO and should a problem arise I could be liable for items that I would otherwise be free from. On the otherhand the customers wouldnt have in writing the terms that protect them such as a workmanship warranty. How should this be handled? Thanks...Read More

I am the POA to an LLC that owns the home where renovations took place. The GC did pull the license then abandoned the project. I had a project manager do the work with subs. GC never pulled off his license. The project is now complete. The GC filed a mechanics lien in the amount of $95,000. No contract was entered into for the home improvement renovation project. The GC did not expend any money as I paid for all the work and workers. Is the GC's mechanic's lien valid?...Read More
