I didn't send a preliminary notice but wondering if we are still able to file a lien

Job was completed on 8/8. Contract we sign clearly states when payments are due and that a mechanics lien can be placed for non payment

A prime contractor is generally not required to send a preliminary notice if they have contracted directly with the owner, as the Mechanic's Lien notice is expected to be in the original contract paperwork. You can still record your Mechanic's Lien within 90 days of completion of the work. In the event you were required to do a preliminary notice, you can send one late but it will only apply to work done in the preceding 20 days. If all else fails, you can fall back on traditional means of debt collection (a breach of contract action, etc.) but will have to proceed without the protection of the Mechanic's Lien to secure the debt.
