We signed the agreement with the homeowner to do the job on 09/08/2018. The work did not start until 05/23/2019 and we finished 6/3/19. We send a Notice of Intent to File A Lien, and now we want to File a Lien, as still did not received the payment. We did not sent the Notice of Lien Rights, as we were not aware we have to. Our customer claims she did not like the work we performed. We have all photographic evidence of the improvements performed on her house. Despite the fact we offered a discount to fix the parts she does not like, although there are unreasoning she is ignoring all notices for her amount due. Do we send her a liens notice or file a case with the court or both? do we place a liens and wait for 10 days and then go to court or no reason to go to court if the liens is placed? never had issues like this before...Read More

Back in 2015 my mom had a retaining wall in front of her house replaced and it is beginning to crack. I checked the contract and it states there is a 5 year "workmanship warranty". My mom has been calling the contractor for about 6 months to a year telling him she sees cracks forming but he tells her to look into other issues like street vibration issues that has previously affected the past walls stability. He won't even come look at it I am fed up with how he is handling this and looking into the contract to see what he actually "owes" us and if he is supposed to fix it, I will step in and if he does not, I will look into legal actions. I am trying to find out my options...Read More

Hello, is it required in the State of Virginia for the lien waiver to be between the contractor and the owner of a property for a commercial office building? For example, if one of our tenants gets a lien waiver from one of their contractors based on their independent third party contract for work within their leased premises, should the Landlord prepare an additional lien waiver between the property owner (Landlord) and the Contractor?...Read More

The contractor remodeled my house in Pasadena, CA. No contract, only verbal. The contractor has no contractor license. The contractor files a mechanic lien on my house illegally because we both have no contract. 3 month passed, the contractor did not file a lawsuit for the lien. I request lien remove/release but the contractor did not want to release the lien to me. . QUESTIONS: 1) How to expunge the lien after 90 days? 2) Should I report the contractor to the contractor board since he has no contractor license? 3) Which website to write bad reviews to prevent the contractor from scamming more people. 4) The contractor wrote a note and signed on my notebook "all paid in full" on my last payment to him. One week later, he files the mechanic lien. The contractor files the lien illegally since we have no contract, no basis to file the lien. May I sue him for illegal filing the mechanic lien? ...Read More
