Can we file a lien more then 120 days after project completion if the General Contractor discontinued answering their phones? We have not yet spoken to the homeowners. These were insurance cases, so insurance fraud could be a possibility. The GC in question has failed to make payment to me for almost 4 months now...I files a pre-lim notice of non-payment...then...filed a mechanics lien to hopefully secure my lien position. (GC,s has responded that I have no lien right position in Tennessee because the GC is asserting that I was an employee.) I have reviewed the IRS standards thoroughly and its seems very clear to me that if the GC did not treat me as an employee while working on his behalf...and ...that e paid $0.00 into the system on my behalf that there is no way that he can now truthfully assert otherwise. Finally, I had to write a very big check to "Uncle Sam" this year because I only had 1099 Income status. (The GC should not be able to benefit both ways!)...Read More

I was hired to do work on a house when it was halfway finished, they brought someone else in to finish it, When I talked to them about it, I got a response that no work was finished, How does one get paid for work that was performed. I agreed to have a handyman that was referred to me by a friend do a paint job for me but after 2 days of work, he proved to not be able to provide the quality of work needed and what was done showed that he didn't know what he was doing and was trying to make a quick buck off of me. In this process I also found his business license to not be valid. I offered to pay $500 and he declined and filed a lien on my property. Apparently served me this paperwork in a city I've never been to on a day I was working in another city but the OC reorder excepted the paperwork. Now he is not only asking for the full amount of the quote, but an additional 10% interest on a job he did 20% of.I had a professional company do the job and they did everything I expected him to do buthe didn't. I red that he would have had to file within 30 days of the project and he is outside of that by 5 days but I need to confirm this information. Is this true?? ...Read More

I am a small subcontractor for a large, international IT company based in California providing services via a middle man. It's just me and my employee. We are delivering consulting services - ongoing intellectual work. The direct contractor is not paying my invoices. There are no objections to the quality or timeliness of our work - the IT company is very happy and we constantly get super positive feedback. I know that the IT company pays the middle man on time, yet I am not being paid. 1) Does the Mechanic's lien work in my case? 2) If so, what counts as date of work delivery?
