We have a job where we provided a one-time order on December 10th. Based on my understanding of the lien law, our deadline to file the lien would be March 10th. The Notice of Nonpayment would normally be due by the end of March (90 days from the last day of Material supplied). Does that mean we must send a notice of nonpayment to the owner before we file the lien, or is it OK to file the lien prior to sending out the notice, but we must notice the job at the end of March? What happens if we file the lien, but don't send out the Notice of nonpayment? Does that invalidate our lien?...Read More

We are in Texas, a contractor threw us off a project and will not pay for any materials or labor for the months we worked. This has hurt our company tremendously. We filed notices on a project on time but because of being mislead with a zlien rep we did not file on the bond in time. So my question is, since we filed our notices on time and it got sent to the bonding company are we able to file or do anything to get our money? Would sending a demand letter from an attorney to bonding company help?...Read More

We have 2 projects with the same gc & owner. the gc has not paid nov, dec, jan & retainage on one project, & is b/c us for item that do not pertain to us. a notice on 2/2/19 for nov, and my boss wants me to lien the project. how do i proceed with dec, jan, retainage notices, without having to wait months out to lien the project. on the second project we only have retainage pending, notice was sent on 2/2/19 as well....Read More

We were hired as a Sub-Sub Contractor to do all the final cleaning for a New Hospital built in Kingsport Tn. The Contractor went though a company called Core Construction Cleaning LLC out of Las Vegas. This Las Vegas Company found us and then hired us to provide the cleaning. There has been no payment and no communication since the work was complete. They will not answer emails or telephone calls. Would I start with the $49.00 notice? Should the notice be sent to the Contractor, Sub Contractor and the Owner of the Hospital at the property owner as well? If the notice should be sent to the Hospital Owner, is it absolutely necessary to include the legal description of the property in the notice? If so, how do I obtain that information?...Read More

We were hired by a GC to do work on a state owned property. On August 28 we received a down payment and began work. We completed one of two stairwells. The general contractor terminated the contract and refused to pay. We sent the final invoice after work was completed on September 8. Originally I was told that in the state of Texas I was not required to send a preliminary notice but it was just brought to my attention that because it is a state owned property that I was required to send one and have potentially missed the deadline to so. I’m trying to confirm whether or not that is correct and if so if I am still able to proceed by sending a notice or what my next step would be . They also failed to provide the surety bond information so that presents a whole other situation ????PLEASE HELP. If not already, I’m running out of time....Read More

We have a client who is a GC, who contracted us to do work for the University of Texas. The client is past due on payment and has stopped correspondence. We have filed an intent to lien and have had zero feedback in regards to that. We want to move forward with the lien. However- Zlien is telling me to file a "Bond Claim"- I have no knowledge of the GC's having a bond on the project. I do know that we do but we do not want to file on our own bond. I need to know if the bond claim is the accurate thing to do next or should I do a mechanics lien? Zlien is not giving me that option....Read More

The homeowner was in contact up until one week before I sent the intent to lien on 9/12/18. We sent it certified mail and it was signed for on 9/14 after attempts to deliver were unsuccessful due to no one on site to sign. Is it too late to file a mechanics lien?
