Hello there. We completed a re-roof directly for a home owner in Texas about a year ago, and she refuses to pay us. She claims that she gave our company a cashiers check but has refused to show evidence of this cashiers check. We have not filed a lien. I would like to file a constitutional lien since we've missed our statutory lien deadline. 1. Should I send the owner a Notice of Intent to Lien letter? If so, should this letter indicate that it will be a constitutional lien as opposed to a statutory lien, or does it matter? 2. The owner is a lawyer. We are a subcontractor on a job in Austin TX. Our original contract was for the amount of $4,518.00 which we were paid. We have a change order in the amount of $2100.00. Catalyst needed a plumbing permit and an inspection which we provided for them with this change order. They were billed for the CO on 12/14/2021, after several attempts to contact them with no success they were sent a notice intent to lien thru Levelset. We had not sent the notice so we had to do that before we could file lien. We have not worked on the job since August 31, 2021. Can we still file that lien? I have a rental house. The tenants called me about a water leak they caused and told me they contacted a water mitigation company to clean up the damage. This work was done before I was notified of the water leak. The contractor tried to intimidate me into signing a contract and I refused. I told him to have the tenant sign it since they were the ones that contacted him. The contractor did no work after the initial water mitigation. My homeowners insurance company paid the contractor $15,331.42 for their work. Now the contractor is threatening me with a lien if I don't pay him $5,089.14 more. He has been harassing me and is now sending me invoices for payment. Can he put a lien on my house after he has been paid? Our case is that we still have 2 invoice in Procore that the GC leave under review and have not paid also . We have not sent a prelien on the 2nd and 3rd one which have the bigger amount. Have a client who we did work for no written contract just texts and of course she allowed us in to do and complete the job (garage organizing and cleanup/hanging and organizing pictures in sons room/and assembly of gym equipment, required repositioning items in order to do and secure, when we sent estimate $1540 she accepted (recorded on SquareUp.com) and we converted estimate into an invoice. It has now been 13 days since job completion and we’ve yet to receive payment (client has always paid us on time and promptly in the past), I have called, left voicemails, and even texted her back. Can we file a lien? What proof must I have? And which lien do we file? How do I go about enforcing the lien, I do believe home may be in her husband’s name though not sure? Will that make a difference? Will it be just for the amount that we originally invoiced or, can we add in the fees that would be for filing, and enforcement and time spent having to do so? Help…we’re just a small business, is it best to just write this off and how do I go about making sure this doesn’t happen to us again…contracts make it all the more difficult in our business and could potentially cause us to lose more business for such requirements…is “good faith”enough? I was a general contractor working on a house remodel. We previous did "Phase 1 " and "Phase 2" was the kitchen remodel...well basically the whole house. During this time the homeowner added a significant amount of work and due to her paying close to what was originally requested for completion minus the additional stuff I lost track of having her sign the documents. She was also displaced from her home for a period of time which made it difficult to sit down and explain the charges she accrued. Also my wife gave birth to twins at the start of the project and that was also a reason for the documents not being signed. I have emails from Ms. Nevins for us to start and acknowledgement of the additional work she wanted and also needed added in order for construction to continue and for MILROK Construction to guarantee is craftsmanship. She began to get very hostile and threatening once she was made aware of the additional amount needed in order to complete her Phase. Due to her threatening behavior I was forced due to safety concerns to walk away from the project and protect my assets. She currently owes close to $58, 000 dollars. This is due to her using the majority of the money on the additional items and overages from the accepted proposal to begin.
