We hired a company to build our pool and we paid based on their pay schedule. We are almost done, just need wiring to the pump hooked up, plaster, and light fixtures etc in the pool but the pool company is now filing bankruptcy. We received notice from the company who was contracted by them to pour the concrete that a lien has been placed on our property as they never received payment from the pool company, whom we paid for the work at the time it was done. What are our options for getting the money back from the pool company that we will now have to pay the concrete company? Are we able to sue the pool company for that money as well as the rest of the money it will cost to have someone else come and finish the job? We have talked to several other customers of this company and it sounds like they front-loaded all of our money without completing the work as described in our contracts and now the company is filing bankruptcy and we’re completely lost. ...Read More

I was hired to do a remodel and started doing the job without a deposit as the contract stated he was waiting for the check. Halfway through the job I reminded the contractor I did not reciebe a deposit and I would need it. The next day his worker came and said he was unable to pay me as he still hasn't got paid. So I stopped work and asked the contractor to contact me. A week went by with no contact so I reached out to his worker and he informed me that the contractor did not want to continue to use me as my price was to high. We signed a contract. I've tried calling and texting this contractor and he never responds. I still have not recieved any payment for the work I done. He told his worker he would pay me for what I did and that was it but it's been a month and a half and I have still not heard from him....Read More

In May of 2020, after many delays and issues, a well respected, established and reputable contractor was hired to do extensive repairs to our home after a severe hail storm when they simply walked off the job in September of 2021. The contractor I hired apparently hasn't paid for the equipment he rented to work on my house. The project at my house was completed in January and paid for in full. The contractor rented other equipment from the same rental company for other projects. The rental company contacted me (note: it's now August) to tell me they were going to file a lien claim on my home. Hasn't the 90 day time limit to file a claim passed? I am a landscape contractor. I did a job without a contract, just verbal agreement. The agreement was to do the job for $8500 and lighting for $1000. I know I told him it would be hard to have much lighting for $1000. I did tell him I do not bid jobs of the unknown problems. I am sure he heard what he wanted to hear. But that I thought I could do it for $8500. At the first day or two of the job, we encountered difficulties that I knew would make it hard to get thing done within $8500. I did not mention anything at that time about how many hours we worked. We continued on the job. And the cost was about $5330. But the labor ran us over 162 hours and that tallies more than $8500. Then the lighting materials were about $1000. But the installation cost more. Near the end the client ask for some trees. I take his wife to my wholesale nursery and we buy $1735 worth of trees. I never talked about landscape stock until this late in the job . We have to move these trees with a bob cat and tree carts . We even transplant a tree . And need soil, compost , fertilizer and mulch. He sent a certified check for $8500 and another $1735 stating trees and landscape paid in full. However , the materials alone cost me more. I can’t even cover the cost of material s and labor. I am in debt $10000. Should I file a mechanic’s lien with success of getting enough money to recover?...Read More

I am a licensed HVACR Connecticut Contractor.9 months ago I placed a mechanical lien on a property. Materials and labor were supplied to a (supposed) friend of 17+years where as a boiler, gas piping and hot water system were installed in his girlfriends home, Subsequently she became his wife. When the now husband was presented with a already discounted bill he refused to pay. We have spoken several times and he has made me offers for less than what the material cost me, this was unacceptable and only after I filed suit against him, his girlfriend and her father did he reach out to me to settle. I filed two small claim suits as the amount was greater than $5,000.00. I withdrew the suit as enforcement (Foreclosure) of the mechanics lien in place may wake him up and entice him pay. It is not worth the expense to litigate in superior court as the cost to defend my position could exceed the amount owed with no guarantee my collection efforts( Legal fees) will be compensated for....Read More

I am a general contractor who performed work on the common area of the condo complex. They are refusing to pay and I would like to lien 5 units consisting of different members of the HOA board. I got an email saying I can lien the entire common area (which is collectively owned by each condo unit owner). I am not sure the best way to handle this. If I lien the common area would everyone in the complex be notified of the lien?
