Clients have refused to pay for Invoiced Labor. Clients called a Work Stoppage. This was intentional, so that they could get out of paying for the Invoiced Labor. Clients hired another General Contractor to complete the Job. Clients have filed with the California Better Business Bureau and the Contractors State License Board against my General Contractor's License. Clients are demanding that I pay for the completion of the work, even though I was only 5 days into the Work. I have tried through Mediation with the Contractor's State License Board to meet all of their demands, even agreeing to $0 payment in order to save my license from having a Strike against it. I have filed the Mechanic's Lien on August 8, 2017, then drafted and sent a Termination Agreement via the CSLB for the Clients through Mediation, that they are now refusing to sign. We are an HOA, and had a contract agreement with a pool vendor, part of our contractual agreement included the closing of the pool at the end of the swim year. Due to poor performance by the vendors, the board decided to do the "pool closing" on its own. The Vendor was notified, in writing of this intent, and is service was not required. The pool was closed on September 15, after the pool was closed the vendor, on September 2nd sent the HOA a bill for the pool closing, as well as other chemical costs. The Vendor was notified the pool closing was not performed by him and therefore the billing was disputed and would not be paid. Despite his use of his own chemical, which was in violation of the working contract the chemical costs were paid, but the remaining $900 dollars plus late fees we disputed as the service was not performed. The Vendor filed a lien on the common areas on January 3, how should we proceed? Should we file a Notice of contested lien, etc?...Read More

I am a general contractor that has completed work ( installed new ducting ) and the customer has refused to pay. I sent a certified letter stating that the account will be sent to collections, upon receipt customer called and threatened to complain on all formats of ratings as well as the BBB if we send to collections. Sent it to collections and customer offered very minimal payment with requirements of lien waivers for his property as well as all the places he contracted our services for which exceeded $12,000. Customer offered $2000. Collections advised us to sue our former customer. I have truck tracking and signatures approving the work as well. The job was completed 08/2021 but we have been in contact with this customer throughout the past year inquiring about payment. What are my legal options?...Read More

I have a friend who owns a house and hired a contractor to do some work. The contractor did not finish the work and my friend is unwilling to fully pay him. So the contractor has put a lien on his property for the 2000.00 expected to pay. The attorney fees that the contractor has incurred is 450 and they are expecting my friend to pay the 2000 and 450. My friend does not want to pay for this because the job was left unfinished and not done well. My friend has no intention of selling the house soon.
