The high level Levelset process on the website states that a preliminary notice is required in WI. However, when I did a deep dive investigation, into this matter, the Levelset site also states that it is not a requirement on private contracts. Please provide specific detain into the Preliminary notice requirement in WI? Do I Need to Send a Wisconsin Preliminary Notice? It depends. In Wisconsin, preliminary notice is generally required to preserve a claimant’s right to make a bond claim, unless one of the specific exceptions apply. Parties who are not required to send preliminary notice prior to making a bond claim in Wisconsin are claimant’s whose contract was for less than $5000, claimants who are employees of the general or sub, and claimant’s listed in the contract between the general and the sub. I was subcontracted by a company to do a roof. I finished the job, sent an invoice and was not paid. He cut all contact with me and blocked me on all levels. So I filed a intent to lien, then my mechanical lien. It was sent to the courthouse and filed. Now the homeowner had a lawyer threaten to file suit against me for slander of title if I dont take the lien off. He said I never filed 779.02 first. I am new to all of this and he said in Wisconsin you have to. Am I up the river without a paddle or do I have a foot to stand on. The homeowner did pay the company but that company has not paid me a dime. I provided all materials and labor. I know, shame on me for not collecting a down payment. I am a subcontractor who worked on a partial re-roof on a house. I sent over my price and it was accepted. Now the general contractors do not want to pay me the full amount of $8,500 due to the insurance company only wanting to pay $1,200. Hello, We have a contract in Wisconsin with KSW Construction. The situation is as follows: Contract amount is $74,550, of which we have been paid $63,275.00, leaving a balance of $11,275.00 (before including our Change Order). Once we include our Change Order for the additional labor done on 3 demising wall openings in the amount of $12,000.00 (which has not been approved), this brings our total contract amount to $86,550.00, bringing the total amount stilled owed to us to $23,275.00. Once we take into consideration KSW's deductive Change Order (which I will not sign until they sign ours) in the amount of $11,320.00, this lowers the amount owed to us to $11,955.00 (assuming all goes as planned). Our last day at the jobsite was 27NOV,2020. I was under the impression that along with the sate of Illinois, we had 90 days from our last date onsite to submit our preliminary notice to the GC. I was just informed by our Illinois mechanics lien attorney, Steve Goba, that each state has its own mechanics lien regulations/restrictions. Your help in this matter would be greatly appreciated. I'm in my 70's; in late October 2018 a contractor installed a new roof to our house. A few days later their office called and said the roof was installed and they require full payment of $10,558.54. I told them the insurance money was in an escrow account with the Mortgage Holder and they can get a check from them. They did get a check and cashed it on Nov 6, 2018. There was other work in the contract, which I think they failed to comply with contract agreements and during the roof install damaged the top of the tree when removing shingles. In early February 2019, they sent me a bill which differed from the original roof amount they requested and charged me for work that was not done or in the contract or approved by me. I called the contractor and they said the work was listed a completed and they would have to check with the crew. In late February 2019 shingles blew off the new installed roof, after several calls they did come out to repair those shingles. In late April 2019, they sent me an email asking if I had the most recent insurance paperwork. In May 2019, the insurance company contacted me about the contractors request and I informed them of the situation and at this time we are not having any future work done by the contractor. I followed up by calling the contractor and recapping the issues and telling them we decided we are not using them for any future work and I think their business practices are not in line with what I expected from a roofing contractor. I also followed up with an email. I didn’t hear anything from the contractor since May 2019. Then in November of 2020, they sent me a letter from the same contractor but different office location with another invoice with the same escalated roof cost and removed the bogus charges for work they said was done but added an undefined supplement charge of $5,527.55 and now increased the last invoice amount from $17,121.85 to $19,276.19. I just ignored this because I don’t know where these amounts are coming from. On February 9, 2021, they send me a certified letter with a new Invoice Date for $19,276.19 with a ‘Prime Contractor Notice of Intention to File Claim for Lien’. I have a gentleman who we did work for, had not paid for almost 4 months, I threatened to take him to court and he said in order for him to mail my check he will need a lien waiver. I feel like this is his way around paying me as I keep hearing stories of him not paying, and he owes employees over $100k . Contractor did not finish job on contract and said he was done. Has been threading me and my wife. Called police twice regarding him contacting us. He’s now threatening us with filing a Lein Paid him 2000 on a contract of 7000 he also did damaged to our wood floors.
