The letter has to show the balance along with any interest that may have been charged. It needs to state who the check needs to be payable too and where to mail the check. I am a subcontractor providing manufactured casework and architectural millwork for a new veterinary hospital in Wisconsin. In August, after the architect/GC approved shop drawings, the owner requested many scope changes. We submitted the cost impact of those changes as a change order request a couple weeks later. Those changes were followed by revised shop drawings including the new scope, and those drawings were subsequently approved. Since that time, the owner has asked several rounds of questions about the costs, but also revised their request to reduce total cost...acknowledging that their actions had cost implications. The job went into production in November, without an approved change order. At the GC's direction, we were asked to meet the schedule and that the customer was committed to the expanded scope and that they would approve the change order. After many promises to issue the change order, we still do not have that in place. The PM recently expressed concern about whether they would even get paid, but still said he would send the change order. Now the job is nearing an end and the absence of that document prevents me from sending an invoice for the total scope. Last week I met with the leadership of the GC and had a very friendly and professional conversation about the issue. I think they were quite concerned that their PM didn't resolve this over the last five months and said they would investigate...though stopped short of promising to resolve to proper satisfaction. The real question is whether or not I can use the process leading up to a Mechanic's Lien? There isn't an actual contractual obligation to pay me without the change order. So can I use a Demand for Payment letter? And can that be followed by a Notice of Intent to file a lien, with the Mechanic's lien to follow if necessary? If not, what other tools do I have for remedy if the owner continues to stonewall the GC?...Read More

Hello, I hired a window company for a patio door and front window. They were to be made to my custom size. I paid $3k down. The company sent out a tech to do a measurement on 4/26/21 and no work has been done since. Installation has been cancelled on me twice on very short notice and I cant get to speak with a manager or get my calls returned. I have paperwork that states the installation will be scheduled when all of the product is available. Both install dates were cancelled because the door was not available yet. Would this be a breach of contract on the window companies part? If I'm able to get my down payment back from my credit card and tell this window company I want to cancel the project; can the window company place a lien on my home?...Read More

I currently have a lien filed through Levelset. I have two years to enforce the lien. However, the owner just listed his house. Lien filed date is 1/22/2022. I would like to know if I need to have the lien enforced and a judgement to be paid out of the sale? I am a handyman that remodeled a deck for a customer in 2019 (signed contract). Last work preformed was in November 2019 due to weather conditions to wet to sand and stain the deck. At that time I presented to home owner with a revised statement stating, I would finish project in/around May 2020 weather permitting.. She verbally agreed. Weather was not agreeable to work on deck in May/most of June 2020. I just discovered home owner finished the deck herself and has her home up for sale, she is currently moving into a new home. The lien rights is clearly in a statement on every contract and is clearly on the contract she signed. Hello, Our company recently sent an intent to lien to a client for work completed in Wisconsin. Work was completed by Emergency Fire & Water Restoration (EFWR) a company we acquired after the debt was incurred. The intent to lien was sent in our legal name Perfection Property Restoration, not the name of the company that did the work. We are nearing the lien deadline and do not have time to change the name on the intent. Is it better for us to file the lien in EFWR name or the company name listed on the intent to lien. I'm a GC and we hired a contractor to do substantial grading work for us on a residential project. He overcharged us and we clearly demonstrated that he had done so and also that he did not follow the engineering for the project. We explained this to him and attorneys got involved. At this point, we are 5 months and 1 day past the last day he did work for us. My concern is for my client. My understanding is that he needed to file a notice of intent by yesterday and since he did not, he losses his right to file a lien. Is this correct?...Read More

I’m a general contractor. I hired a sub to perform work on a residential property. I paid him half down at job start (Aug 2nd) and he walked off the job about halfway through (sept 24) He just sent an intent to file lien to the property owner (dated dec 8) unless the remaining 50% is paid. I don’t think they or I should have to pay for work that wasn’t completed. He sent the 60 day preliminary notice with the intent to file (dated dec 8) Does he even have lien rights since we are well past the 60 days? And if not, do the property owners have to contest the intent to file? He can’t proceed with filing if he has no lien rights, correct? Thank you! ...Read More

I am an independent contractor who owns a roofing business. I have completed they’ll work with pictures attached. I have not been paid payment for more than 60 days. This was an insurance claim that I worked very hard to get for him. It was a $16,000 job whereas, he only gave me $5200. 00 down and fired me the day the work was complete. Walt's Petroleum Service, Inc did a job at C&G Mini Mart located at 910 State Highway 102 W, Rib Lake WI from Aug 10, 2020 to Aug 20, 2020 and haven't gotten paid $202,415.69 for the job. We have done ongoing service for this location since construction was completed. The last date of service was June 10, 2021. Total amount due is $252,498.40.
