Payoff letter

Hello, We filed a lien through you for Kimberly Aguilar and she is now selling her home and the title company is asking for a payoff letter for the property. The letter has to show the balance along with any interest that may have been charged. It needs to state who the check needs to be payable too and where to mail the check. And lift the judgment on the house once we receive payment. Can you help us with this?

It's common for a title company to want a full accounting for what's owed when trying to resolve a mechanics lien claim. And, there isn't really one form, format, or template for doing that - it really depends on the situation and what the title company is asking for. With that being said, based on your question above, it sounds like they're asking for relatively simple information. It sounds like they're simply looking for an accounting of what's owed, what portion of that amount represents interest. Presumably, they'd cut a check based on that info. They're also asking who the check can be made out to, and an address for where the check should be sent - which should be simple. Further, it sounds like they're looking for an affirmation that the lien will be released once it's been paid. So, including simple language that promises to release the filed lien once payment is in your account should suffice. Unfortunately, though, this is not a form or service that Levelset currently provides. Still, if you're wary of drawing up this type of document yourself, you can always consult a local Wisconsin construction attorney for help drafting that document.
