I asked a similar question earlier, but I don't think my question was very clear. We are an aggregate and ready mix supplier. A customer placed an order with us but provided the wrong address. We delivered to one address (the actual property that received and used the material) then sent a preliminary for a different address. The properties are very close. We believe the customer did this to prevent us from properly establishing lien rights. It does not appear the customer owns the correct property, but is the general contractor. I was working a residential bathroom remodel, the contract was for 22627.01, including tile cost when selected and with change orders and additional work, verified through emails and verbal change orders the total became 27752.78, I was paid intermittently total of 13000. when it came to 1 more day of work to just knock out a very small punchlist, the night before I asked for 10000 and allowed him to hold a retainer of 4752.78 until the next day when i completed the job and he was happy. He denied the 10000, wrote a check for 2000. then the next day, I was told that I was not allowed back to the property and that my workmanship was unsatisfactory. Then he offered 2900 only if i signed a letter of dissolution. Hes now threatening to file fraud with L and I. all the supposed poor workmanship was the things I had on my punchlist, The bathroom is absolutely beautiful, Ive showed pictures to alot of people and everyone agrees that its a great bathroom and the amount of work I put into it is close to 300 hours. Throughout the process, there was never a single complaint and his wife even said multiple times that with my work skill and knowledge of processes and supplies I should have my own improvement show or broadcast on youtube. But the day before it was time to settle up, my work all of a sudden was unsatisfactory. pictures are up on my website. www.waunatile.com under a.d.a. compliant remodel. this guy owes me almost 13000 and all my prices are completely justified, hes making up prices for my business, what do I do, I have 400 to my name as all I had went into this project....Read More

This is a large project on public land (a new community essentially) Yet the "Owner" of the project is an LLC. The job has gone south. They lost an arbitration award of 11.49 million as they were found to have "actual intent to defraud Lender:). The lender supplied 66 million in funds of 132 investors. We are a Subcontractor (concrete road construction, sidewalk, curb and gutter. The GC stopped work on the project for non payment. It seems I can't lien the public property. They have a Bond, but Levelset is asking for a municipality for an owner. Not sure how to proceed...Read More

If we are being hired by the general contractor on behalf of the property/homeowner - do we have to mail the Notice to Owner directly to the property owner or are we covered if it just gets mailed to the general contractor since that homeowner has essentially given the GC to hire work on their behalf?...Read More

I'm a General Contractor on an exterior painting project for a Condo HOA. The agreement/contract was signed by the president of the HOA for the work. All owners have paid their respective balances except for one owner. Do I lien the specific owner unit, or the entire building? This notice of right to lien is included in my contract, "WASHINGTON STATE LAW, RCW 18.27.114, REQUIRES CONTRACTORS TO PROVIDE THE FOLLOWING NOTICE: “This contractor is registered with the state of Washington, registration number TERAPPC804NQ as a contractor and has posted with the state a cash deposit of $6000 for the purpose of satisfying claims against the contractor for negligent or improper work or breach of contract in the conduct of the contractor’s business. This bond or cash deposit may not be sufficient to cover a claim which might arise from the work done under your contract. If any supplier of materials used in your construction project or any employee of the contractor or subcontractor is not paid by the contractor or subcontractor on your job, a lien may be placed on your property to force payment. If you wish additional protection, you may request the contractor to provide you with original “lien release” documents from each supplier or subcontractor on your project. The contractor is required to provide you with further information about lien release documents if you request it. General information is also available from the Department of Labor and Industries”. I ordered windows in May. The project manager went against company policy and agreed to make Egress windows for my home. We agreed to terms in the contract. We were approved for financing to start the window process. He was fired in June for not following company policies. New project manager reached out to me to make addendum to repay me $3970 back, because they couldn’t complete the egress windows. I agreed. August 3rd windows were installed. Windows were missing vent covers. Notified project manager of issue with windows she said she would get me the vents. September I emailed the company for payment information. No reply to 3 emails. 4th email I received email back from the finance office on Oct 29th that my financing of the window project is about to expire and that the 2nd project manager was fired and they had lost my paperwork. Nov 2Nd I signed all paperwork and then on Nov 14th I received a letter saying that financing has failed and I owe them $24k for windows. If I fail to pay by Wednesday Nov 16th they would put a lien on my property. I tried to call them 3 times and emailed them. With no reply. What are my options? Thank you for any guidance. Here is my dilemma - I filed the lien and the company wrote me a check on 7/18/22, which I deposited. According to the bank, they have 7-10 business days to stop payment or cancel a check. They wanted me to sign an unconditional lien release, which of course I did not sign.
