customer is refusing to pay me job was 98% completed all but a door that they knew was a few out and every attempt to locate possible replacement was made to no avail. Job was build 150 ft of fence and demo 52ft of fence and build a 10x12 shed with certain additions to it. Owners last told me that they wanted their home inspector to inspect it before they would make payment and of course their paid inspector came back and said there were all kind if issues and work was substandard job was in city limits and was permitted I verbally informed them of intent to file and was sent a email stating that I am to cease and desist any further communication with then or they would file harassment charges with local law enforcement ...Read More

This repair was made to the home through a property management company. We made several attempts to collect from the property management company but they said it was the responsibility of the homeowner. We reached out to the homeowner several times, but to no avail. We receive many unconditional waivers to sign before they will release payment, which I believe in incorrect. However, if the waiver does not state whether it is conditional or unconditional, I am trying to figure out if the wording of the waiver will tell me which it is. Many of the waivers have the wording "The undersigned lienor, in consideration of the sum of hereby waives and releases it's lien and right to claim lien through ". We were General Contractors on a new driveway ramp, stem wall, entry way steps, and ADA parking ramp for a commercial property. After completion of the job the tenant refused to submit our invoices to the landlord until multiple additional change orders were completed. We tried to request the landlord be present at a meeting with the tenant, but he did not send the request to the landlord. It wasn't until communication broke down that we were able to find out who the landlord was but have not received any communication from the tenant or the landlord since we sent a summary of a mediated meeting. Neither the landlord nor tenant are responding to communication attempts. We are going to put a lien on the commercial property, but a fellow contractor suggested we file a Foreclosure Lien as well. Is this something we can do on a commercial property and if so, how do we go about filing this in Travis County in Texas? Any help would be much appreciated.
