Good morning, our company is located in Southern California. Our customer order materials amount of $90,265.52 and address we received was 985 Spur 100 in City of Kerrville. I put a Mechanics Lien. My customer gave me wrong address. I did some search and found out The correct property is owned by City of Kerrville.
If it is own by City of Kerrville: Can I put Mechanics Lien against City?
How can I put lien against our materials?
Can I put lien on my customer who hired/ order the materials?
Ive never been in this situation before so I don't know what to do. Your
help and guidance in this matter is greatly appreciated!!!

I purchased a home 10/26/18; Affidavit of Lien filed on property records 12/13/18; Notice of Certified Letter Sent on 12/13/2018 - went to post office to pick up on the 17th.
This is a subcontractor who provided "building materials" on a home that was being flipped. First date of service 8/31/18; last date 9/18/18. The General Contractor did not pay the subcontractor. The previous owner was in contract with the general contractor, whom paid the GC. I am an innocent party and did not receive notices, nor was owner at time. Best approach to handle situation. In the past I have sent Notice of Intent and Liens to properties where the contractor has not paid us, I am receiving phone calls from the homeowners telling me they paid in full and have documents to prove it. I sent a separate question re: a lien in Florida. We have almost identical situations happening in these states.
We were to supply a residential project in Texas, the subcontractor sent us a PO, confirmed our order, we made the material, sent one truckload of material (and were paid for that) and then were told not to send any more. We have charged them for our standard restocking fee (25%) as they haven't taken the product that they contracted and agreed to take. They have not paid the fee. We have issued a legal letter and are going to issue a statement of claim but also want to look at lien options. We issued the restocking invoice on Oct 25. I am concerned we're past the timeline to be able to file a lien, hoping that there are other options here for us....Read More
Contractor was fired on 15th August 2018 after multiple delays and not paying subs, files a lien on my property which was about to close by attaching fraudulent invoice. Contractor was paid in full and also removed HVAC, Microwave and kitchen vent just before getting fired and did not give it back.
On 15th August 2018 the contractor demanded for another $60,000 to complete the work which we refused to pay, as we had already paid them over the contracted amount. We fired them on the spot, went to City of Houston permits department and found out that none of the city inspections we completed and house was red tagged. We paid some of the subs who were not paid by the contractor again secures their loyalty and completed all the jobs. We got the house under contract on 30th October 2018 and found out that the contractors have filed a lien with one fraudulent invoice which they made up on their letter head....Read More
We had to have our flat roof redone after damage from a hurricane.e We haven't paid for the roof due to fact the new roof leaked throughout the house day after it was done & the damages from the leaking. We just had new AC Unit installed in our condo & paid $3500, wasn't installed properly, had to be fixed once already - no fee. Still under warranty, the air flow was not good since installed. Made appointment for tech to come out and was assured there is no charge, since the unit is still under warranty. Problem was not fixed, we put in our new lighter filter in hope it will help while the tech was here(the current filter was less then 30 days in the unit) & we are being charged $79 for pretty much changing a filter that didn't need to be even changed. We don't want to pay the fee & Contractor is threatening us to put lien on our condo. There is nothing in writing, just assurance over the phone there won't be a charge. Now he claims it cost him money for gas to come out no matter what. Two completely different stories. Please can you advise us what are our rights? Can they sue us & put lien on our condo? The homeowner was in contact up until one week before I sent the intent to lien on 9/12/18. We sent it certified mail and it was signed for on 9/14 after attempts to deliver were unsuccessful due to no one on site to sign. Is it too late to file a mechanics lien? This is in Texas and the laws governing this situation are confusing.
