An incorrect General Contracting Company was listed as a General under "Project Stakeholders" in addition to the correct General Contractor, who was listed as "We were hired by". The General that was listed incorrectly contacted me to let me know they were not the General for this project. Does this Notice need to be corrected and resent or because the correct General was listed under "We were hired by", is it okay?...Read More

Hello, are there any special requirements for U.S. Government (Military) projects, or does it default back to the rules of the State in which the Military Base is located? Specifically, we are an equipment vendor and installer, who was a subcontractor to a contractor working at a military base in the State of Ohio. (Military Base ==> Contractor A (holds contract with military base) ==> Our Company Contractor A is refusing to pay us the remaining balance of our Invoice. Contractor A has credit and cash flow issues, and we've found out that it is defaulting on other payments for other projects. We did not send a "Preliminary Notice" but we would like to go ahead with a Lien anyways. Thank you!! PS - We are a NC Corporation that is a Construction Materials supplier, however we can work in all 50 states (not as a licensed Contractor, but as an equipment supplier.) If you are a Construction Attorney, we'd be interested in learning more about your services so we can be better educated in Contract Law and Construction/Payment Law (and possibly having all of our Contracts reviewed prior to signing the Contracts....Read More

My father's house burnt down almost a year ago. We decided to go with the contractor the insurance company is in contract with. The house has been down to the studs since April with no progress. I was just looking at the claim and found out the insurance company has paid the restoration company over $160,000 for content and dwelling. My question is related to the following. We did a preliminary notice on an address that we thought was the location. This was to the best of our knowledge at the time. The customer did not pay. We are the CG on 2 public school projects in Ohio. The projects that are already recently started, but I cannot locate Notices of Commencement on the respective county recorders' websites. Should I still file a NOF immediately or wait to see if the produce an NOC? Since we are the GC should we file the NOC in 10 days if the NOC does not appear to be filed? Or would we need to be specifically asked by the school to be an Owner Designee? In that case should we also file an NOF or just NOC? Also do I need to obtain bond information and how? We are bonded, but I'm not sure, should the need arise, how we would make a claim against the public bond without the info. Thanks!...Read More

In Ohio, if the General Contractor has a direct executed contract with the Owner -does the General Contractor have to send out a "Notice of Furnishings" or is the Notice of Furnishings in Ohio only for Subcontractors and Material Suppliers who do not have a "direct Contract" with the Owner. The General Contractor is using subcontractors on the Project. We know "when" there is "no" Notice of Commencement filed with the County, no one has to send out a "Notice of Furnishings" to preserve Lien rights in Ohio. It seems everything is silent on any specific process for the General Contractor to follow other than for the General Contractor to file a lien if he does not get paid without anything being said about doing anything before the lien is filed to preserve the General Contractor's lien rights. ...Read More
