We are a NY millwork company selling doors and mouldings, we have a customer in NJ that we delivered goods back in September 2021 and we haven't received payment, we still have custom doors, meaning doors that we usually don't stock we just ordered and assembled for them but we did not deliver yet. Can we still file a lien and still meet the NJ deadline of the "last day on the job" since we did work for them at our shop? Thank you...Read More

I placed a lien for money owed. I allowed it to expire and chose not to act on it and foreclose. The building owner is threatening to sue for allowing it to remain on the record. The money is still owed. I chose to not foreclose or file for removal because I dont want to spend a single dollar more on this. Am I obligated to remove the lien ? Can i be sued?...Read More

We are a manufacturing company that is supplying materials to a general contractor for a project in New Jersey. We are not clear on the rules in NJ for what is considered first labor/material furnishing date. From our own research, we found conflicting information that we would use the date material was first delivered as furnishing date. But also read that if we provide a substantial amount of labor prior to delivery, which we do as we are a manufacturing company, we would use the date we first provided labor on the job such as fabrication, design, etc. We understand that preliminary notice is based on this first labor/material furnish date and want to make sure we are using the correct date. We are a material supplier that fabricates and ships metal panels for building exteriors. We supplied panels to a car dealership in New Jersey. A preliminary notice WAS sent, but sadly the deadline to file the lien was missed. We received a message through LevelSet that the deadline to foreclose on the line is in a few days.
