My friend had a commercial property in NJ. The HVAC people did not complete the job and placed a lien on the property claiming that they did. They also claim that there were change orders but can provide no proof that they were done or even agreed to. Someone told me that before we can go to court and ask that they court remove the lien we have to bond it out. Is this true?...Read More

I am employed as an HVAC technician by a large company contracted to provide maintenance services for a NJ public school district. The contract requires a full-time HVAC tech onsite. I was told that they only need to pay me for "wrench time" on specific tasks. They will not even pay me for taking my tools off my truck-ONLY for "wrench time" spent on say an air handler. Can you please clarify how a Master HVAC tech, Master plumber, or Master electrician should be paid in this type of case? Is the company required to pay the prevailing wage for each trade for 40 hours per week or just by the "job"? Again, the contract calls for the provision of a Master HVAC tech, Master Plumber, and Master Electrician to be onsite 40 hours per weak, and NOT for the provision of "HVAC service" or "Plumbing service" or "electrical service". I applied for a VA Mortgage through Loan Depot on my home that I own free and clear. I had a $200,000.00 line of credit at my disposal. I am doing major construction on the house. As part of the process,LoanDepot told me to close the equity line> I had a closing on the mortgage on Aug. 15. About 10 days later LoanDepot informed me that the VA would not do the loan because there was no money owed on the property. They suggested that my contractor put a small mechanics lien on the property. The VA would then process the loan, pay off the lien and everything would be fine. I was going to do that, but don't feel comfortable. What do you suggest? i need the loan, but don't want more problems....Read More

I hired a contractor to do work on a renovation. We agreed upon a price and I made all payments in full accordingly. 6 weeks after starting the job, he claims he underbid the job. After making final agreed upon payment, he handed me a bill for "extras" that is 2x the amount of the original agreed upon price. At no time during the job did he ever indicate which work performed was extra and how much the extras were going to cost, or receive approval to proceed. He is now threatening a mechanics lien. I have a subcontractor who bid an amount to work on a residential renovation. After beginning work, 6 weeks later, he stated that he underbid the job, and "revised" his initial bid to 2.5x the amount in a text message. I requested a meet to discuss this matter, but he did not meet with me until after the original agreed amount was paid in full, and over 90 days after saying he under bid. I never agreed to his revised bid, but was willing to discuss it. Furthermore, he is now requesting payment for items he states were "extra," but at no time during work indicated the items were extra, presented a price for those items, received approval or billed or provided any change orders.
