I'm not being fully paid on a residential project. I reached out to the owner of project and advised a lien would take place. I was advised a full lien waiver was signed by GC on job. The GC did make a partial payment to us but we never signed a waiver or was even asked to sign one. The owner basically told us there is nothing we can do to them and they aren't paying any thing. That we need to work it out with GC as they have been fully paid. How do I proceed now?...Read More

hello . Please help i am trying to sell my deceased mother home. The title company has found a mechanic lien on the house thats dated 25 years ago. I have tried to contact the company it no longer exit the person is deceased that filed it. The title company back then no longer exit. The now title company says HUD has it. I contacted HUD main office in Washington DC. They have no record of no lien in my Mother name. The house is about to be foreclosed soon. I wanted the money to get my mother headstone. We placed a lien a property back in July 2020. He partially paid (~80%) of the invoice. And he was suppose to pay for the cost of the lien release fee. After he paid, he disappeared and never answered my calls so I never released the lien. Can he sue me for not releasing the lien? ...Read More

I am currently mid-project, and the work by the contractor does not meet code, is generally shoddy, and the original contractor has begun to sub-contract out the work to temp agency hires. I've paid approximately a third of the original quote, and I'd like to have them simply stop where it is and take what I've paid so far as final payment, so that I can get a better quality contractor in to complete the project, but not end up with a lien. I am a soon to be homeowner of new construction. I used one contractor to build my home. He threatened the title/disbursement company (they called the police and filed complaint), he threatened me and my employees at my office (I have a restraining order), he went to jail in June 2020 for having a stolen bulldozer on my property, and my bank fired him in January 2020 for his behavior and poor work. His last working day on my property was January 7, 2020 and he filed a mechanics lien July 13, 2020 for $90,000. The only work that was performed was excavating on the driveway and putting in a foundation. The normal price on the foundation is $36,000. He was paid $85,000 (therefore he was over paid). There were a few subcontractors that he never paid and I had to pay them out of pocket. We have all lien waivers, receipts, and copied checks from the disbursing/title/bank. I hired another builder who had to repair the foundation in order to continue the project. To repair the foundation was 10,000$. The first builder left a bow in the foundation, no drain tile, the turret measurements were off, the back wall had to be cut out and leveled, and some of the ties are leaking when it rains. I have a small leasing company and I am disputing some late charges from a finance company, I send a payment in full for the balance and other misc. charges. I did not include the late fees and marked in the memo line that the check was a payoff with the account number. The finance company deposited the check and state that I still owe the late fees. Do I have to pay the late fees if they accepted the check that stated it was a payoff?...Read More

I terminated a real estate agent (using a lawyer) due to her doing very unethical things with my home. She put a mechanics lien on my home after we terminated her! She put a mechanics lien for her commission on our home and has put us in a financial crisis ! We cannot afford to hire a lawyer to get this removed but every lawyer has told us this was fraudulent to even do ! Is there a way we can represent ourselves to the judge or get a lien waiver !
