We had a brick cleaning contractor that hasn't completed the job and billed for the whole amount due. Then he is trying to charge $300.00 interest after only 7 days after I received the bill. He also said that he is going to lien the property and his lawyer fees are $3,800 which we will be charged. Our problem with paying the whole bill is that he caused damage to our customers brand new stainless steel hot tub with the acid wash he uses and us and the customer had to pay someone to try to buff it out to hopefully fix it. This was out of our pocket not the brick cleaners. We owe him $1,700 and we look it as a fair amount to pay him only $1,000 due to the damage and the uncompleted job. Can you please give me some advice for this situation on what we should do? Plus, is him trying to charge so much illegal?...Read More

Hello, I had a terrible storm hit my subdivision, causing major hail damage to my home and garage. I hired a contractor back in early 2020. He was a door-knocker insurance contractor. He played a sob story of he is a single dad, raising his daughter on his own (she was with him). I too am a single parent, so I hired him for the job. I thought I was doing the right thing, but it turned out to be a homeowners worst nightmare. It took the John (contractor) over 8 months to complete 2 Roofs (house and garage), gutters (house and garage), a very small section of siding on the back of my house and awnings on the house (another company was hired to do). I have multiple violations per the city building inspector on my roof (house), currently. There is also work per the insurance estimate that was not completed by John, including no materials were ordered to perform the work. The contractor is currently sending me threatening and harassing text messages. And of course he is threatening to also put a lien on my house. I paid John almost $9900 the insurance company issued as the depreciation check, the full amount in the check. He is stating I still owe him $4600. The breakdown is $1942 from the materials check issued from the insurance company (for work he did not complete and poor craftsmanship), $1692 that is my deductible, even though he told me verbally he would take care of that. He did not subtract $300 for having his sign posted up on my lawn for 5 months. And $973, an additional check issued from the insurance company for the awnings that have already been paid in full to John and to the awning company. Due to the violations currently standing with my roof, is the contractor still able to file a lien against my home? ...Read More

I'm a GC working on a residential home remodel. We had an initial contract that the homeowner signed and has made partial payment on. Since we started working, there were added jobs the homeowner asked us to do. We got approval for everything but mostly on the phone. We never did any work without the homeowner's approval and most of the time we were able to give them a quote for how much the added job would cost. They suddenly took an issue with some of the added job amounts and told us to stop working. Most of the jobs were either complete or mostly complete. Now they want to pay us half of what we're owed and this includes not paying us for unfinished jobs (which are mostly done but we had to stop when the homeowner asked us to). We sent an email containing a total amount owed and the homeowner said they'll leave everything up to the mediator. I'm not sure what that even means. I work hard and have never had a homeowner do this. I understand I'd have to prepare a lein and file it with the county. Just want to make sure I'm not missing anything. My partner and I did most of the work but we had a subcontractor do some electrical work. Would I only list the electrical sub in the sworn statement or should I also include all the work we/GC did? And assuming we get a lein, what's next?...Read More

In the state of Michigan, my contractor gave me an estimate of $90,000 to repair water damage on my small cabin. We had a good working relationship. I paid him. Covid happened, and I did not visit the cabin. He then claimed there was water damage, and he had to redo half the work. Hie charged me $39000 for the "redo" There are no pictures of the damage, although I asked for them at the time, and he "doesn't have to"give me any lists of materials used. I also have no hot water. He claims he is "not responsible" for that. He promised to repair a few things, but has since filed a mechanics lien for $39,000m on the house. I told him I would pay him (just so he goes away) but I don't have 40,000. I would pay monthly for a year or so.I asked that we not involve lawyers & extra fees (like liens). What are my options?...Read More
