Washington State homeowner has paid contractor (our customer) in full. We have not been paid by contractor and intend to file a lien on the property. Owner will dispute our lien based on his payment in full to contractor. My most up-to-date info is from 2019 and I would like to have more recent confirmation for WA state. Is the homeowner responsible for the full balance or only the unpaid amount of the contract?...Read More

This is a large project on public land (a new community essentially) Yet the "Owner" of the project is an LLC. The job has gone south. They lost an arbitration award of 11.49 million as they were found to have "actual intent to defraud Lender:). The lender supplied 66 million in funds of 132 investors. We are a Subcontractor (concrete road construction, sidewalk, curb and gutter. The GC stopped work on the project for non payment. It seems I can't lien the public property. They have a Bond, but Levelset is asking for a municipality for an owner. Not sure how to proceed...Read More

How long does a Lien last in WA state? We have filed our lien and the owner is working to get it resolved. However, both our supplier and us claimed the materials owed. The Owner obviously doesn't want to pay for materials 2 times and has asked us and our supplier to go into escrow and modify our Lien with to remove the difference. We also want our supplier to be paid and agree to removing that material portion from our lien. However, we do not want to lose our abbility to collect the remaining owed balance and want to know if there is anything we should be careful of?...Read More

If we are being hired by the general contractor on behalf of the property/homeowner - do we have to mail the Notice to Owner directly to the property owner or are we covered if it just gets mailed to the general contractor since that homeowner has essentially given the GC to hire work on their behalf?...Read More

The agreement was that we get 3 payments of 22000 we got the 1st payment of 22000 and I paid for the machinery and the middle payment of 22000 I only got 10 of And Mr. Frank wouldn't pay me the rest of it right there is a breach of contract I couldn't finish the job due to the fact of the payment I needed for the rest of the machinery And Mr. Frank would not pay me any money at all he told me he wasn't gonna even pay me the end even if I did finish the job he wouldn't pay me the end payment so it's come down to this where I have to put Aileen on his property to get payment for all of work I've done even though the agreement was for 30 days and that was the contract we did it for 2 months so I'm adding Restitution for Labor for the other following month that was not added so I'm asking for the amount of what the contract is stated for since he broke the contract with us I'm asking for the whole amount of 68000...Read More

I have a question about conditional waivers. A lot of general contractors don't pay invoices within 30 days and at the time of submitting a new invoice (which requires the inclusion of a new conditional/unconditional lien waiver), more than the current month's billing is still outstanding. If this is the case, should the total amount outstanding be put on the conditional waiver, with the through date of the current billing period, rather than just the amount of the current billing? Or are the prior billed & unpaid amounts covered by the conditional waivers that were included with those billings? It just feels wrong to put only the amount of the current billing on the conditional waiver with a through date of the current billing, if the previous billings are still outstanding. We filed lien. The lein was submitted to a company, with what we thought was plenty of time. We still had a subcontractor there under our contract for 2 more months. We are in a major lawsuit now with them owing more than 300,000 to us. Around 40,000 goes to subcontractors that haven't been paid due to homeowners final payment. The rest is out of our own pocket, around 100,000 of profit.we have a lawyer hired by our insurance company and even though our lein is possibly invalid they want us to release the lien. I am running out of money and patience. They want a couple hundred to release the lien. I am kt sure I want to. I know for sure I don't want to lay fkr it if I ca. Stull use it.
