About half of our business walks in our store and requests same day equipment delivery. Our customers are mostly GCs. It looks like we have to send a NTO in order to secure full price lien rights. It also sounds like the owner must actually receive the notice before we furnish equipment. Is there anyway around this? Would posting an NTO in the job site board satisfy the requirement? ...Read More

We received a called from the general contractor attorney trying to get settled for a lesser amount and keep our right to pursuit the subcontractor who hired us for the rest of the amount owed to us. I'm trying to find out the law on a mechanic's lien in Al. A contractor working on a medical building only paid one of the labourers and the other 4 received nothing. The contractor withheld the fact that he paid the one person and refuses to pay the other employees. I'm the material supplier for a private job in Alabama furnishing a subcontractor. I a notice to owner in advance of furnishing to obtain a full price lien. The law says the owner can avoid responsibility for a full price lien if it provided a notice before the material is used that it will not be responsible for the price of the material. Does this let them off the hook of a mechanics lien as well? There's no information provided that appears there is a tenant involved, as the owner is contracting this work done. ...Read More

For work done in Alabama, we noticed that the dollar amounts of supplies need to be listed on the Alabama Notice to Owner. If we presume that the amount listed on the letter was the amount that was billed at the time of sending out the NTO, what if more material is billed on this job after the notice goes out? Would that impact our ability to lien for the full amount billed if it is more than what went out on the notice? Second, if we list a contract amount on the NTO for residential work, should the contract amount be used on the NTO, or should we use what has been billed at time of notice? ...Read More

I am a homeowner and have a potential mechanical lien coming my way. We have terminated our GC and he has told his subs he will not be paying them because of his termination (no pay if paid clause in place). We have been paying the GC through our lender after the HUD inspections have passed, and he signed the lien waiver and release for his termination payment which contains verbiage that all subs have been paid. Could there still be a claim if the sub was paid through the GC, and we have these forms proving payments? ...Read More

I am a material supplier typically hired by a subcontractor or GC. I usually have 0-2 days notice when I am hired to deliver roofing supplies to a job site in Alabama. The Alabama NTO law requires that I must deliver a NTO certified mail return receipt prior to being on site in order to secure lien rights. This is not feasible for my company.
