When a preliminary notice and Notice of Intent to Lien have both been sent, often, the next step toward payment recovery will be filing a Florida mechanics lien, itself. However, re-sending a Notice of Intent to Lien, or potentially sending a demand letter might help to push for payment. While mechanics liens are typically the nuclear option, they do become necessary at times when payment isn't coming. Keep in mind, too, that a Florida mechanics lien will no longer be available if more than 90 days pass after the last date of furnishing - so there's a clock on how long you'll have to pursue a lien. Granted, there are always other options that will be helpful for payment recovery - like pursuing a claim under Florida's prompt payment laws, under breach of contract, or some other legal theory.
