I’m a subcontractor who is having payment issues with the prime contractor paying the bill. They have allegedly exceeded their budget and took the project over. Upon leaving the project I request a job walk with the company and inventory verification to avoid future issue and they didn’t comply. The customer stopped the job due to permitting issues for 2 months we got the property almost ready and he has two invoices not paid. They reached out to restart the job and we stated we will not start without the payments and he said he will no pay until we start working again. As a result, we cut ties. We are bringing a general contractor on board before we have a full set of drawings due to a very tight timeline. The contractor has provided their budget for general conditions. We want to enter into a contract with them and they have provided an AIA 101 and AIA 201. However, they have not entered any contract amount, not even the general conditions amount we had discussed. My question is: where in the contract can they enter the general conditions amount? We understand that the rest of the budget will come later, when we have finalized the drawings. I just feel that we are signing a contract, there should be at least the amount we discussed for general conditions. Please advise your recommendations.
