A ready mix company has filed a rogue statement of lien. No work was contracted for nor performed, but the spurious lien was filed in Jefferson County. What action should be taken against the ready mix company?

An attorney can draft a demand to remove and that usually works as recording a mechanics’ lien where no such right exists can subject the party to criminal action.

A mech. lien is never spurious--Tuscany. What you have is a fraudulent lien and there ready mix loses all their lien rights and owes your att. fees and addt'l damages.
