If you roofing contract states "lump sum" to be paid at the end of the re-roofing project, but the roofing contractor ask you for a payment of material and some labor at the beginning of the project and you pay to keep the contractor interested in finishing your re-roofing project, does that contract still exists as "lump sum" contract or has the terms and conditions changed?...Read More

We only have a verbal agreement on the work im supposed to do and he keeps adding more work and I'm thinking he's assuming I'm doing that for the same price that we discussed I told him that wasn't the case and he said we'll talk about it and he said that he would be fair I'm thinking he's not going to be so fair so when I write up my bill and mind you a lot of things I not going to charge him for but some things I am so I'm wondering do I need to and can I file a pre lien if I've already started the work I'm in Minnesota...Read More

I am a subcontrator doing framing for a customer home. the GC that contacted us got fired and a new GC took over, we kept working with them but the owner of the house got involved and is the person paying us.
The customer stopped the job due to permitting issues for 2 months we got the property almost ready and he has two invoices not paid. They reached out to restart the job and we stated we will not start without the payments and he said he will no pay until we start working again. As a result, we cut ties due to the lack of agreement. How do I ensure to get pay when they do not want to pay for a job performed?
I have filed a mechanic lien but we want our payment. Also since the job was never finalized, are we liable after they hire someone to finish it?...Read More

There is typically a time gap in between when we install a fireplace and when we return to start-up a fireplace. The fireplace is usually unable to work until we assemble the media and do the start-up, which is based on the contractors readiness for that final step. They can hold 10% for which they say is retention or completion. This can take 1 to 2 years until that time. Would our lien deadline be based off of the install date of the return date?

Hi, what must my town do to pull a bond on a housing development that has not been completed by the builder? Builder just needs to finish road and punch list items but has been ignoring town. Additionally town has really dragged their feet holding accountability so we are concerned they may not be able too. Development has stated since 2012 …...Read More
We currently have a lien that you placed for us and the client is angry about it and wants us to sign an unconditional lien. That will terminate our lien rights, correct? We have completed the contract for which the lien was placed but have moved on to a T & M schedule instead. What should we do? Sign the unconditional and place a new lien? There are two problems. We know that the project will continue to December, but have no idea of the dollar amount of what this is going to be.
Second problem, you placed the lien on the property owners as well. They are trying to sell the property and the lien is causing some issues with the sale. We really don't want to release the lien, but what are the legal ramifications if we do and don't remove the lien involving this sale?...Read More
We are a subcontractor who is being required by the general contractor, who we have a contract with, and our payment is being withheld until we have an unconditional waiver from our subcontractor. We have a signed conditional release from our subcontractor and the canceled check for that release but the sub is refusing to give us an unconditional for the that payment and our general will not accept those documents as proof of payment. Are these 2 documents together sufficient to serve as an unconditional release, are there any statutes for this?...Read More
How do I have this lien removed? Contractor is unlicensed and I have a verified certificate of non-licensed status from the CSLB. There is no actual contract and the work being billed for is 70% uncompleted. Unlicensed contractor started the job beginning Feb and finished 4 days later, and Levelset filed the lien in June. It is clearly an invalid lien....Read More
