I am a subcontractor. The project we are working on has run several months past the original completion date, for various reasons, none of which have anything to do with our company. The GC keeps giving me the hours are hours speech and not recognizing I have additional costs related to these project delays. Instead of 20 guys working we only have 5, but have other costs involved. Including: Multiple rental equipment, fuel, overhead and housing. What notice do I need to send to properly notify the GC of the increased project costs? There is nothing stated in the contract agreement for additional costs requests....Read More

We are a subcontractor that was contracted by our customer on a large commercial job. The customer, General Contractor, was of course our main contact and who we were to report to. Our customer signed our legal proposal agreement for the scope of work needed, but did not provide a contract of their own to us. Nevertheless, our proposal/agreement contract stipulates that if signed its considered a legal agreement. Unfortunately the GC was negligent with all project matters, responsibilities, and work progress and reporting causing us and the property owner schedule delays and loss of money. Consequently the owner finally confronted the GC and decided to fire the GC. We then were recently offered a new contract directly with the property owner. The question is, we still technically have an agreement with the prior GC for a contract amount, and unfortunately our contract did not specify any breach of contract terms, what should we or can we do with the previous agreement made? Also, we placed a preliminary notice on the property with the previous GC's information, should we or must we create a whole new preliminary lien process to preserve lien rights with the new contract made with the property owner? I've filed a lien on a residential(non-owner occupied) property in Tulsa County, OK. What is the next step, if the debt remains unpaid? The debt owed is $2350.00 and the property owner is trying to get the Tulsa Housing Authority(section8/HUD) to approve the home as subsidized housing, for his ex-wife, who he purchased the home for in 2013. He requested me to do some payment but did not provide me invoice, and I requested him to provide me the project on-going list to against the payment. And He did not execute the remodeling job according to the drawing approved by City building, and missed 3 new windows, until 4/12/2022 San Jose City inspector pointed them out. We are an electrical subcontractor working on a public works project and for no reason the GC is trying to cancel our signed contract. The GC asked our electricians to leave the jobsite, mid day the other day and will not let us return. The GC will not give us a reason and will not return my calls.
