Breach of Contract

CaliforniaConstruction Contract

We are an electrical subcontractor working on a public works project and for no reason the GC is trying to cancel our signed contract. The GC asked our electricians to leave the jobsite, mid day the other day and will not let us return. The GC will not give us a reason and will not return my calls. We need to, at least, be paid for the work we have done and billed for. Possibly the entire amount of the signed contract. What are our legal rights?

Initial steps would include filing a stop payment notice for the amount that has not been paid. If you were a listed subcontractor on the list submitted by the contractor to the public entity, you also have a right to a hearing before you can be replaced. You should also consider making a claim against the payment bond, and potentially filing a complaint with the Contractors State License Board. I suggest you retain the services of a lawyer experienced in construction matters to assist you. If you are in Northern California, I may be able to assist.
