I was hired to install a sink. The sink was installed but during installation the countertop was damaged. The damage could be repaired and I purchased the repair kits and started the work. The original work was completed. All was fine until customer was asked to make a partial payment. At that point she said she was unhappy with the incomplete repair and wanted to file a claim with my insurance. She was given insurance info. Our written and signed contract states that if any damage occurs that my company will either make repairs or hire a 3rd party to complete the repair. Also, given the event that customer chooses to hire their own 3rd party, they would be responsible for payment to that 3rd party and would relinquish me of all liability. It should also be noted that she did tell me that she received a quote from a 3rd party to have her entire countertop replaced. I believe that she crossed the line when she expressed that she had formally received a quote and requested my insurance info. A claim has also been filed with my insurance, that was done by me. Given all that has transpired, is she still responsible for the original sink install, which is completed and in perfect working order? Thank you for your time and assistance....Read More

I finished my work at the client's house somewhere on February 2022. I knew about some financial difficulties my client had by that time, and because it is a person I've known for the last few years I decided to wait. The total amount this person owns me right now is $10 000. The last check I received was on 9/6/2022, and since that I haven't received anything, only text messages promising payment. This person is not willing to pay even a small amount every month. Here is my question: can I file a lien as a private person? We never made any agreement, so in this case to I need some witnesses that I actually did my work on that house ( carpentry)? Is there any timeframe I should follow? I would appreciate your response. I'm a contractor and I'm having an issue with a Designer that prepared my construction drawings I've paid him money over $7000 part of the contract price to prepare a set of plans to submit to the city. He did prepare the plans and I submitted them to the city however when the corrections came back from the city I can't seem to get him to finish the job and make the city changes. He's been giving me a lot of excuses, lying about when he'll have my corrections ready over and over again. I've been chasing him over 2 months now and can't get him to honor the contract and finish the job. I'm loosing a lot of time which is affecting my ability to build the home and make money. I'm sort of stuck because he is the one that created the plans and now I can't get the changes done. I would like to know what my legal options are. Am I able to sue him for the money I paid plus damages, stress etc so that I can find another designer to get this job done. I don't want to just loose out here. ...Read More

My husband and I own a full service flooring company supplying materials and installation. We have a customer who owes us $50,000 however we did not file a preliminary notice. We don’t usually have this problem. We have just prepared a notice of intent to lien and plan to serve it tomorrow. I received a letter from an attorney stating to lift the lien then client will send a settlement check. What if I lift the lien and then no payment is sent. Can I demand a check be left with client's attorney to be forwarded to me once I show proof that lien has been lifted? I fear I will lift the lien and no payment will be sent. We missed his payment being made, we changed systems and payment was not recorded properly. He wrote back the following. I have never heard of this ? We released his lien right away then we receive the following. Over the weekend, I received multiple hard copies of the Release of Mechanic's Lien, which was inadvertently placed on my property. Unfortunately, Chantel Jackson, did not properly or legally correct her initial oversight filing. It appears she took the quick and easy fix and checked the box saying "lien has been paid and satisfied in full". This statement is factually and legally incorrect. As you know, I paid all outstanding invoices many weeks before the lien was inadvertently placed on my property. Under CA law for situations like this one, the lien must be expunged not just released, thus eliminating it entirely from my records. If Chantel does not understand this, I am more than happy to explain the process to her. All things considered, I don't think it's unreasonable for me to ask that this matter be properly and legally resolved. ...Read More
