I am the sub-subcontractor on a state/county school in Texas. I sent the bond claim to the property owner and general contractor, but I didn't have the bonding company information so it wasn't sent to them. My attorney is telling me that the bond claim is not valid because it wasn't sent to the bonding company. Is this true? Either way, are there any next steps that I can take to get paid? We are a wholesaler for HVAC equipment. We supplied materials to a local contractor who installed these materials at a charter school in Indiana. Charter schools are considered public schools in IN. The school secured a loan thru a local bank, and that loan is backed by 3-4 individuals in the community. Would I file the claim against the local bank or against the community individuals backing the loan (the bank has not been forthcoming with the names of these individuals)? Also, what is the difference between a Title 4 project and a Title 5 project? I'm not sure if it makes a difference in my case?...Read More

The company I sell for supplies floor and roof trusses to builders in South Florida. (2 progress payments) We shipped floor trusses to Buildings 4 and 5. We received payment and issued partial waivers for those specific amounts. In the next pay cycle we shipped building 5 roof trusses but not Building 4. I am an ongoing subcontractor in Ohio. Our client has been paying us for over a year. They have now started to default on payments. We have not field a Notice of commencement as the type of work we provide is billed by the time and not the project. Some of the work was in assistance with their production as a refinery and some was in building up their facility (real property). They have acknowledged the they owe the moneys due.
