I am a subcontractor who has not been paid on several projects that we have past the normal deadline to send a registered letter to the contractor for the unpaid balance and also past the 15th day of the third month. Is there anything we can do to recover the balance we are owed?...Read More
I am a subcontartor that has been providing labor, materials, and payroll capital to Tenacious Builders and or TBI(he goes by 2 company names for suspicious reasons) since 3/16/20 and continuing forward . We agreed upon a 50% profit split. We have built 5 residential homes to pass inspection. One home that is complete, but yet to be inspected. Currently in the middle of building 2 more houses. I recently told him I cannot work with him anymore after we finish the 2 we started. I cannot work with him any longer because he doesn't show up to work very ofter, and the general contractor has noticed that. After I told tenacious I'm done working with them, he tells me that once these homes are finished I should expect a bill from him!? his reasoning being he is providing a forklift at $1000/house. he is under the impression id be paying $500/week for the forklift. this was never agreed upon in writing nor was our 50% profit split. I am yet to be paid for the house we completed that has yet to be inspected, and there are 2 more houses to be finished which puts 62,500 revenue on the line that he claims I will owe him money on. I feel as though I am being robbed, and manipulated. I have filed a preliminary notice on the house that is completed but yet to be inspected. what are my options mechanics lien, or suing in small claims? thanks Ken moran 6515921616...Read More
Did the job and the owner is not paying. Haven’t sent any notices yet and didn’t send a preliminary at the time of signing. I got half down and she didn’t get her loan to do the rest of the work so when we finished one phase now she’s not paying. ...Read More
We did hurricane related mitigation work on properties in Florida in 2019. While our portion of the work was completed, the construction work on the home was not completed until 2020. As we did not do that work, I am not sure of the date of the completion. Our invoice for work was sent January 14, 2020. Am I still able to send an NOI and/or file a lien? The amount of the invoice is ~$43k. ...Read More
I am an architect in California and want to reserve my lien rights on a project by filing a 20-day preliminary notice. I understand that the notice must be sent to the lender. I do not know who the lender is. It is possible that the owner has secured project funding from multiple lenders and/or investors. Must I discover who they all are and notice everyone? How is this done if the owner is uncooperative and refuses to provide their contact information?...Read More
Since the mail has been slower than usual lately, I'm worried that some preliminary notices won't arrive until after the work is finished and paid, particularly on jobs with a quick turnaround. Do we have to wait until we first furnish labor/materials to get the preliminary notice sent, or can we start that as soon as the contract is signed?...Read More

We're a subcontractor in California. We sent a preliminary notice and completed the job about 80 days ago. And we just found out that the job address that the preliminary notice was sent to, was a wrong address by one digit. It should have been 459 Hilledge Dr instead of 458 Hilledge Dr. And the two properties belong to a different owner. In this case, is there anything we can do to protect our mechanic's lien right?...Read More
