MinnesotaMechanics LienPreliminary Notice

I am a subcontartor that has been providing labor, materials, and payroll capital to Tenacious Builders and or TBI(he goes by 2 company names for suspicious reasons) since 3/16/20 and continuing forward . We agreed upon a 50% profit split. We have built 5 residential homes to pass inspection. One home that is complete, but yet to be inspected. Currently in the middle of building 2 more houses. I recently told him I cannot work with him anymore after we finish the 2 we started. I cannot work with him any longer because he doesn't show up to work very ofter, and the general contractor has noticed that. After I told tenacious I'm done working with them, he tells me that once these homes are finished I should expect a bill from him!? his reasoning being he is providing a forklift at $1000/house. he is under the impression id be paying $500/week for the forklift. this was never agreed upon in writing nor was our 50% profit split. I am yet to be paid for the house we completed that has yet to be inspected, and there are 2 more houses to be finished which puts 62,500 revenue on the line that he claims I will owe him money on. I feel as though I am being robbed, and manipulated. I have filed a preliminary notice on the house that is completed but yet to be inspected. what are my options mechanics lien, or suing in small claims? thanks Ken moran 6515921616
