On this project site located in Columbus, OH we supplied equipment to a general contractor on a federal project. At the point which (the subcontractor) had gone unpaid by the GC for 3 months, we sent in a affidavit claiming our amount against the bonding company in December 2019. We (the subcontractor) received a response that the claim was denied on 3/5/20 and put together a rebuttal with proof against the reasons given for claim denial and submitted this to the bonding company on 3/31/20; it was acknowledged on 4/4/20. this is the 7th week now and we have received small excuses from the bonding company like "we are getting to it" or "the bonded GC has outstanding questions to send back to us". I am concerned the bonding company is buying time. I am wondering how much longer (as the subcontractor) should wait before we begin a lawsuit process....Read More

We are a subcontractor on a Public Works project ( Waste Water Treatment Plant), the project was supposed to be complted December 2017 but is still ongoing. we have been paid to date on everything that is owed to us except for retainage, we are 89% complete with our scope of work. I am a land owner who has leased several tracts of land to construction companies. The construction companies are allowed to hire contractors to perform work, erect buildings etc...on the property. Although my contracts say that the construction companies are not to allow liens to be put on the property, sometimes their slow pay process, does cause contractors to place mechanics liens against them, and on the property that I own. I want to avoid allowing liens on the property that I own by my Lessee and the way that they conduct business. If I require the construction company to obtain a payment bond prior to the work being performed, can I require a lien waiver or subordinate the lien somehow to the Payment Bond?...Read More

Steel Standing was hired as a sub contractor to provide the labor for a job on Fort Jackson. I was hired as the second tier sub, not directly with the Prime contractor. Your Roofers, LLC who was contracted with the Prime Contractor turned in certified payroll to the prime contrator. However they never did pay the guys, my company paid the guys. Now i am told the prime contractor will not pay the contractor i am contracted with due to not fullfulling their contract. When i ask Your Roofers, LLC about submitted fake documents they indicated they are going to pay all the tax liability on the guys on the cerified payroll. However, bottom line, Steel Standing, LLC paid more than $ 120,000 for labor on this job and now can not get paid. There is no profit in that number either. ...Read More

We are a subcontractor. The job is for a Native Tribe. The GC (non Native) has a payment bond but won't give us a copy. I believe we have a right to a copy of the bond. I was hired to do plumbing work on a condo remodel. The total came out to 1200. While there the contractor had me basically finish the rest of the remodel. I was only paid 600 out of the 1200 for the plumbing and told the rest was coming, by the time I finished the rest of the remodel I had not received the 600+I was still owed so I added that to the invoice for ththe condo remodel. The total was $2100 o believe, the contractor then asked me to do another job in scottsdale which I was hesitant to do with out receiving payment on the first and second job still but he talked me into it and said he would have payment by mon or tues. so I started the 3rd. Job and had to put close to 400 dollars into materials on this one. When Tuesday came around no call no reply to my text and of course no payment as stated so I didn’t go back to the job on Wednesday. That evening. The designer of the job started texting me asking me to go back and finish it stating she would pay me personally even tho she had already paid the gc for the job. So I agreed and worked on it Thursday-sunday even missed out on another $2000 job for someone else just to try and help her get this $700+job done. Well all said and done, Sunday rolls around and she says thank you I’ll make sure the gc pays you in full for the job and she does not pay me a dime. Ow it’s been almost 2 months and I still have not been paid for any of the 3 jobs. The gc has an excuse for something every time I text asking about It. What’s my options?
