Prelien projects, in Ca., for State or County jobs. Do they need to provide a payment bond?

We are a material supplier, Our customer is the sub contractor, the job is Yolo County Main Jail. It is a large job, apx. $30,000.+ Can I ask for a payment Bond or anything like that?

Hi, I asked a question about Bonds & Public Jobs, on March 10th. I haven't heard back from anyone. Does it usually take this long? Thanks, Pam

General contractors on state and county projects in California will need to secure payment and performance bonds when the job exceeds $25,000. So, if a public project is expected to cost over $30,000, then the job is quite likely bonded. As for obtaining a copy of the bond - it looks like California doesn't have some tools available in other states for getting a copy of the project's bond. Often, the project's GC or the surety will be required to provide a copy of the bond upon request. However, looking at the relevant CA Civil Code provisions, I'm not seeing the same type of options for getting a copy of the project's payment bond. Still, requesting a copy of the project's payment bond from the GC or from the public agency in charge of the work could be helpful. GC's should be pretty familiar with requests like those if they regularly perform public work. And, if neither is willing to provide a copy of the bond, then a sub could use a Freedom of Information Act request to get ahold of it: Getting a Copy of the Payment Bond | Freedom of Information Act.
