I was a subcontractor for a project under a GC who was under a 'Master GC / CM'. The GC for whom we worked did a horrible job. They were kicked off of the job. We requested to be released prior to that GC being fired by the Master GC / CM and were supposed to come to terms on our final payment. When we have a contract with the Owner of a job, do we need to send a Preliminary Notice to the owner? Or does the contract take the place of the notice?
Additionally, if there is a bond on such a job, and I send a notice to the Surety Company, do I list the Owner and General Contractor on the notice, even if I'm not mailing notices to those entities?

We are contracted with a door manufacture under a GC on a Navy installation, and our contract is with a subcontractor of the GC, and in our contract we have standby and delay times and have over $70k in change orders for being delayed and put on standby numerous times, and the company we are contracted with is stating they don't have to pay us unless the Navy pays them, even though they agreed to our terms for the standby time were disclosed and greed out the gate and we are NOT pay hne paid, our contract is NET 30. We are a subcontractor on a public project in Fairfax VA for the Fairfax County Housing & Development Authority. The GC is based out of Maryland. The current Balance is $93k. GC is insisting we sign an Unconditional Lien Release in order for them to release payment. (They are paying 95%.) They will not accept a conditional release. Terms of the contract state "all Waivers of Lien and Subcontractor’s Affidavits shall be in a form that is acceptable to GC". I am not giving up our bond claim rights without having payment in hand. Job is bonded but we failed to send the required Preliminary Notice. Can you advise a way to proceed? Thank you in advance for any help.

I am a subcontractor on a multifamily development that has from day one had payment problems. They are now 90+ days and owe us nearly $300,000. Our contract allows us to walk off the job at 45 days and lien at 60 days. Neither of these consequences have mattered. The job is mostly at a stand still for weeks, other subs are unable to work waiting on us and the GC is asking if they pay the past due when will we return.
