We are a Subcontractor primarily working within CA, but we now have a Washington Branch. I see the Preliminary Notice requirements are quite different. I have a couple of questions. When we have a Subcontract with the General Contractor for commercial work over 60K, do we need to submit a Model Disclosure Statement? If not, why is the requirement for less than 60K, but not over 60K? Also, the Washington Notice To Owner (Preliminary Notice) which reserves our right to lien. Is this sent for every project no matter the contract sum? Is there a different process or forms if we are contracted with the Owner vs. the GC? Are there different notices depending if the project is Private or Public? Please advise....Read More

I did 2 bathroom Remodel and haven't been paid. Owner Supplied all Material. I gave her Estimate of $2,100 main bath & Master bath $2,500 due to Shower walls were gonna be tiled. Main bath under tub/ shower floor was rotten so I fixed it. I last worked there on 4-10-2021 I did everything and then some to help her out. Hotel Project (Commercial) - Owner signs "percentage of construction" proposal using the AiA Document B102, Standard form of agreement between owner and architect. (2007) Scope creep starts at 2,000 sf, and finishes at 5,000 sf. A $10,000 difference in professional fees from 2k SF to 5k SF. All 5,000 sf permitted by City of Tacoma. They are refusing to pay for the final of the initial 2,000 sf draw and the minor additional "sideways" services. I understand from RCW that I need not file a notice of lien claim. I need help please. A subcontractor filed a lien on my property. The general contractor (who was sent by my homeowner insurance) didn’t pay and went out of business. I never got a pre notice about this lien. He’s filing for labor only but he brought material to do the project at my house.
