We are based in Florida but currently have a job in Washington state. The NTO I sent was a Florida form and now the Spokane airport has paid the GC, but prompt payment has not been issued to us (sub-subcontractor). I was hired by a property mngt company that I have worked for for over three years, we have an ongoing contract for services that names me as an authorized vendor. I started the job 8-14-17, emailed a notice to owner 11-20-17 and completed the job 10-6-17, sent a notice of intent 11-28-17.

I found two liens that my company filed many years ago (2012 and 2002). They still appear to be attached to the property when searched on the county's assessors page. My understanding is that liens in Washington state expire after 8 months if not enforced. If so, why are these liens still attached to the properties? Do we have any obligation to remove these liens? Our customer gave us the incorrect project info and the prelim notice went to a homeowner rather than the HOA address where the community pool is that we supplied material for. We last supplied material on 6/30/17 and they are refusing to pay roughly 30k. Is it worth attaining legal counsel or have we lost our lien rights based on the incorrect NTO that went out?...Read More
