My fence contractor began work back in the beginning of May. They never filed a Preliminary Notice. Their work is terrible and while they have now completed the job yesterday (8/19/2021) to the best of their ability though not perfect, the refuse to take less than full payment. They want to put a lien on my house for the balance of $1877 as I am willing to still give $1877 additional to the $3755 owed. I am also the leasee of the property owned by a trust where I am the beneficiary, but not the trustee. Can they put a lien this late or take any action against me for non full payment? The person who filed that lien never supplied a bill and they did not complete the work - it did not pass inspection. The lien was put on the property 10 months after the work was done. We find three scenarios that keep coming up. 1st when it is a single family home and we assume it is the owner. When when we file the Preliminary notice we find out that the person who signed the documents is not the owner. 2nd when there are multiple units but it is a condo type scenario and we think we are dealing with the owner of the property 3rd when the tenant called us out and we know we are working for the tenant or it is obvious it is an apartment complex. If we have completed the Preliminary Notice with in the 20 days of starting the job and no one steps up to pay the bill can we file the mechanics lien and will it more than likely go through? We are a small swimming pool maintenance and repair company. We were contacted by a homeowner to help with a inground hot tub remodel. Are part of the job was just to replace all of the old equipment with new equipment and make sure everything is working correctly. We also helped finding a company to do the replastering. The owner signed the bid and gave us 50% down which was used to pay for half of the plaster and the equipment. The job is now completed and the owner is refusing to pay the rest of the bill. He is trying to say he wants it inspected and that we should have pulled a permit. Which I have verified we didn’t need to do, since no upgrades were done. Because we didn’t file a pre- lien within 20 days of starting the job do we have any other options to file a Lein now or do we have to take him to civil court? ...Read More

Our company provided construction labor and some construction supplies on a project in bountiful Utah. It was a cost plus agreement. We started the project in June, were paid timely for our first invoice, July paid timely for our second invoice. Came back in October after the custom material had been delivered under the same agreement. Once our last invoice was sent, the property owner contested the invoice and only paid about 30% and has since been very difficult to get an answer from as to his intentions on paying. Our company in based out of Idaho. The last date that we worked on the property was on October 24th, 2019. Are we still within our lien rights for Utah? We have made weekly attempts to communicate. For the last four weeks the property owner is seeming to stall, giving no real answers as to his intentions. What would you suggest? Thanks ...Read More

Typically the department for this zlien user will receive a copy of the contract for a new project, but won't know the exact start date until the month after. Since they won't know the start date until after the deadline, could they file the preliminary notice when they receive the copy of the contract?
