My neighbor owns a construction business he started about 30 years ago. The last couple of years has been a struggle for several reasons; his wife became very ill; projects were completed but not tracked for payment so he has both old and new debt that he wants me to help collect. His office manager of many years retired and the replacements have not worked out. I have some experience in debt collection but not construction. He has not been successful in finding the right person for this job and he is convinced I am the person that can turn this around. And, I think I can certainly do more than is being done but I need to know the most efficient and law abiding process to get cash flow to his company. The sub is contracted through us for a TX project. They have not issued the required 2nd and 3rd month notices. Do they have a lien claim without this? They have a supplier that is owed and has not issued their notices as well. One invoice from Nov. is on their claim, which they should have send notices on and filed their lien by March 15. They have not lien rights for this claim correct? Do they have any other recourse that could affect us or our contract with the owner? The other invoice is from January, which we are just being made aware of now by them contacting us. Still no 2nd month notice. Does the letter suffice as their notice and if so ensures they have a lien claim?...Read More

I was hired by a GC to replace 3 HVAC systems in a burned out church. A mechanical permit was pulled by our Company and 50% of the signed proposal was paid. A city inspector conducted a preliminary inspection because the GC would not provide access to the new location of the replacement equipment stating we had to entail the cost. After 4 days the GC complied with the inspector request to provide access. At 95% completion of the project a cover-up inspection was conducted and pointed out that motorized fresh air would have to be installed for the project to pass the final. A change order was sent to the GC for the installation of the motorized fresh air dampers. The GC stated he was paying the change order and if we did not install the motorized dampers by a certain date we would be fired off the job. Two days later the GC went to the City and terminated our permit and would not let us access the building to finish the project. A final bill was sent on that date....Read More

I am a material supplier, who supplied a $3k fire valve to a fire contractor on 12/5/17. That contractor installed it in an apartment complex in Mesquite Texas. The contractor had received the invoice on 12/5/17 as well as a statement every month on the 1st and 15th since. I was getting pushed off, but now I need to follow legal action. I had a house built and my builder hired someone to build the fence. We signed an agreement that I would pay the builder after closing on the home based on the estimate he provided. He wouldn't send a copy of the invoice or receipt of the job. I found out the contractor he said did the work, actually did not do the work and I have that in writing. He won't tell me who did the work or if it's under warranty but expects me to pay what's on the contract agreement we signed. To lien, we have to file by the 15th day of the 4th month following unpaid draw, so January unpaid, means we file lien by May 15 and so on. Fund trapping notice (retention) is to be filed following completion, so we would file after we are done providing to the site correct?...Read More

I am building a new house. I have a Builder that holds the Mechanic's Lien rights. I would like to contract directly with each tradesman instead of having those contracts go through the Builder. Is that allowed? I plan to secure Lien Waivers from each tradesman. In this case, I'd be listed for both "the person with whom you contracted" and as the "owner".
