We worked as a sub-contractor under a General Contractor on a project, and the General Contractor had us sign a unconditional waiver and release on final payment form even though we have not been paid anything on the entire project yet. I have the document we signed, does that waive our rights to file a mechanics lien. I have an email stating that from the GC, and we wrote on the unconditional waiver that they owe us the total dollar amount. Mechanics Lien Rights?
Texas My son, Paul, who lives in Houston, and I, in Illinois, own the Houston house together. It is being remodeled for resale and payments have been made for materials, etc., right along. Work is almost done and Paul plans to withhold 10% before final payment. No lien waiver was completed. Pierson sent me a copy of the Conditional waiver and Alex believes that is what Paul needs to have signed. However, it asks for final payment information. Are we protected against any mechanics lien between the last payment and the final 10% if he completes the conditional waiver? Can the form be modified to include both payment dates? If not, what does he need to do? I am trying to help out; being retired I have more time than he does to search out the information

TexasI am on the lending side and would like to pay a vendor. When I asked for a conditional release upon final payment they said that the affidavit should work instead.
TexasWe had a contractor replace the roof on our house and it was through an insurance contract versus an estimate given (this was considered void once it became an insurance claim), we are not comfortable with the way the contractor is asking for final funds stating it is not money out of our pocket but insurance funds paid to us. TexasWe are a zlien, but we currently do not use zlien for waivers. Instead of printing, signing/notarizing waivers and then uploading them, can zlien notarize with a saved signature to help make that process faster in states like Texas that need a notary for waivers? Is there some requirement that would not allow this?
