I just have a general question about the mechanic's lien. We filed a lien on commercial property owned by a large national company. We are a supplier and our customer was paid in full but never paid us yet since he is having financial issues By the way all of this happened in South Carolina. We do know that by SC laws the owner is not obligated to pay twice for something they already paid a contractor for and I am wondering if they can force us in any way legally to release our mechanic's lien or can the lien stay on the property until we are paid in full? Our management doesn't want to release the lien until we are paid in full. I have a feeling that this will drag out and I am wondering legally what can be done or if we can be forced by their legal to release the lien. We never had this happen before. We were working in SC, employed a sub who employed a man. He has since filed a mechanics lien for non payment. I have a signed lien release from teh sub who employed the gentleman. Is this legal for him to lien Rogue even though his employer signed a lien release? Rogue Response, LLC...Read More

Hi, I need help with a problem. I have a customer who we have at least 11 jobs that we completed totaling $57,405.51. Six of the jobs were completed but I have not receive payment for and those jobs are over 90 days old. One Job I have already lien and two others I have sent intent to lien. The customer sent me a payment of $16,784 which covers one of the lien properties and two properties with intent to lien. The customer wish for me to remove the lien and retract the intent to liens. I rather apply the payments toward the oldest charges and to keep the lien on the property until the customer settle up the old debt. I am within my rights to do this?...Read More
