I was contractor and material supplier. for residential job in New Jersey. My single owner company worked on job site back to back two years. i never get paid so I put Construction lien after completion job and UCC 1 with Financing statement. Now JP Morgan Chase moving forward for Sheriff sale/Eviction. Please advise what to do next ? Thanks

I was wondering if in NJ we can file an amended Mechanical Lien after original Mechanical Lien was rejected for following reason: "This construction lien is rejected because the timely filing date has passed. You have 90 days from the last day of work to file a construction lien. Also lot and block must be listed."

New JerseyImperial Cleaning is a contractor for monthly Janitorial (cleaning services) to a Client in NJ. Our client has not paid for services on the monthly cleaning job and supplies. We have invoices from January- June unpaid. We submitted a notice of intent to lien, however we have not heard back from the client. I was wondering If we could send a Mechanics Lien. The options only state Construction lien.
We have provided supplies and upkeeping for the improvement of the real estate property.
New JerseyDo you have an emergency restoration contract form? In NJ a construction contract requires an estimate. If a firm provides emergency services it is impossible to give an accurate estimate and if services are not rendered immediately smoke fair and water damages can become more severe. Can one use a cap for services in lieu of a formal estimate
New JerseyThere are 2 properties with 3 different AIA scopes. On one of the properties I have 2 separate scopes with 2 different pay sheets. Much of the contractors payments on all 3 of these have been sporadic and often not designated to a particular job or scope. How do I quantify what has been paid and where? And lastly there is a bunch of additional work done on one particular scope that has been discussed and categorized via email. Hours, designation and acknowledgement of them by the contractor. But they are not on the AIA. They have paid me for them. I just want to make sure they do not try to show those payments as part of the regular contract. Please let me know. Thanks

New JerseyWe filed a Mechanics Lien which was rejected by the county recorder because "the timely filing date had passed". but there was an office error and we got the dates wrong. Could we file the lien again with correct paperwork to back up correct date? Were in NJ.
New JerseyI'm an electrical contractor and worked as a sub for a GC on a public project for a housing authority. Full disclosure, the GC and I had a falling out and we refuse to work with him after completion of this project. We completed the project and when he sent us the final lien release for our retainage payment, he advised he was withholding money because we did not install a water heater control panel. He claimed he had to bring another electrician in to complete the work. 1. No where on any of the contract documents is a water heater control panel shown. It is shown as a single point connection on all drawings, which we did. 2. The submittal for the model of the water heater used does not show it needs a control panel, or that a control panel is even an option. 3. We were never notified that a HWH control panel was needed. Therefore, we never had a chance to submit a change order. If this was change order work, then it would be above our contract amount and he still could not back charge us for something that was not on the drawings to complete. 4. If this work was complete, do I have the right to see if an additional permit was taken out? Our permit had one control panel for the boiler. The boiler control panel we did install. I do not want to be held accountable for any work associated with the HWH control panel. 5. I have been working with the housing authority to help straighten this out. Their representative met with the engineer that stated a HWH control panel is standard and we should have assumed there would be one, even though it is not mentioned on any contract drawings. They are also claiming we didn't connect the boilers to the generator. (This is the first time I'm hearing about this.) The drawings show a new panel being installed for the boilers, which we did, and that panel fed to a distribution panel. That is where our work ends. There is no mention of doing anything to connect to an existing generator. I honestly feel like I'm being gaslighted here. I'm trying to have a meeting directly with the engineer, but it seems that he doesn't want to admit to any sort of wrongdoing, but the principal of the matter is that I whole heartedly believe we are owed that money and the GC is trying to stick it to us because we had a falling out. I don't know if I have any hope here because the engineer is backing the GC up with inaccurate claims. Is there anything else I can do?
New JerseyI'm a sub contractor and we have a contractor withholding payments from September and October of this year. He is claiming for non-performance, but the work that was in those pay apps is completed. In addition, there are material charges for material and equipment that is on the site and installed. I received confirmation that the contractor has been paid through 10/31/2022. My understanding of the prompt payment act is that the contractor can withhold payment for unsatisfactorily performed work, but how far back does that go? Since our pay apps were approved for the months of September and October, isn't he required by law to pay us for the approved amounts? He has not provided any information that our pay apps were fully or partially denied, even though I have asked repeatedly. He continues to claim that we are not manning the job to his satisfaction, which is his opinion. He has not given us a substantial completion date. He continues with empty threats that the owner is unhappy but continues to provide any actual documentation proving this fact. Should I move forward with an intent to lien at this point?

New JerseyI did a job for the customer and now they do not what to pay and i saying there not going to pay me because they do not have the money and that she lose money because it was not done on her dead line date bout i had told here that she was not going to meet her dead line date because we couldn't supples weren't coming in and her people that she her quite on here.
