Hi, My company recently did some metal work for a new hotel that was being constructed. I placed a mechanics lien on the hotel back in May/June of this year to ensure that my company would be paid for our work, given that the owners were acting very erratic with the money. I found out today that the hotel recently opened for business last Thursday (9/10). Should my lien have been satisfied first prior to the hotel opening for business? Thank you, Rickin ...Read More

Subcontractor for a GC who come to find has no license and isn't registered (no address) to perform HVACR work on a job in Rumson, NJ. My company is fully licensed and insured. i am an unpaid sub on a job. Freedom Mortgage is holding a final draw on the property. i could not get homeowner to agree to pay me so i filed. now that i filed, we have agreed to paying me out of the final draw from the bank. The bank however wants me to record the NJ release of unpaid balance form BEFORE the money can be distributed to the GC/Homeowner. I am a first tier subcontractor on a residential project in NJ. I have a job that was completed 72 days ago. I approached the home owner before the job was completed and explained that her GC was not making payments on the job and she agreed not to pay him the balance and would paid us direct. She did not pay the GC the balance but she did pay other subs to get them to come back to finish the work and now states she has no money left. I notified her via text of our intent to file immediately upon completion of the project and she said that she would pay but has been giving me the run around. I did not file the NOI because of her making false promises to pay. Can I still file a lien if my notice of intent is after 60 days and the home owner has paid other subs. My company designs and supplies equipment to contractors. The first thing we do after receiving an order is generate an engineering submittal, which can take up to 6 weeks of labor. Then the customer approves it, or asks for corrections before approving it. This approval is our first billing milestone. So when setting a "Date Labor or Materials Last Delivered" in zlien, do I use the date on which we begin expending labor? Or do I use the date that submittals are approved, which is the date where the customer believes they've actually had something 'delivered' to them? There are 2 properties with 3 different AIA scopes. On one of the properties I have 2 separate scopes with 2 different pay sheets. Much of the contractors payments on all 3 of these have been sporadic and often not designated to a particular job or scope. How do I quantify what has been paid and where? And lastly there is a bunch of additional work done on one particular scope that has been discussed and categorized via email. Hours, designation and acknowledgement of them by the contractor. But they are not on the AIA. They have paid me for them. I just want to make sure they do not try to show those payments as part of the regular contract. Please let me know. Thanks...Read More
