Rejected on Mechanics Lien - Should we do anything additional to remove it.

New JerseyMechanics Lien

We recently received a letter from a Lawyer regarding two mechanics liens that were rejected over a year ago. The liens were rejected because we were over the "90 day" time frame on both. I presumed since they were rejected that that was the end of it. Should I have done something more to remove these liens off the records?

Yes. If you have an improper lien on a property - especially if someone has pointed out that they believe it's improper - you can be held liable on a claim for slander of title. The analysis has to start with whether the liens are actually problematic though. Some will make the argument the liens are improper to get you to remove them even when the lien is valid. You should have an attorney review them and provide you with some feedback. If the lien needs to be removed, it can then be done. Both pieces of work should not be terribly time-consuming. Feel free to call me if you would like to discuss it further. 484-531-1701
