i am an unpaid sub on a job. Freedom Mortgage is holding a final draw on the property. i could not get homeowner to agree to pay me so i filed. now that i filed, we have agreed to paying me out of the final draw from the bank. The bank however wants me to record the NJ release of unpaid balance form BEFORE the money can be distributed to the GC/Homeowner. How can i record this BEFORE i get paid? i cannot lie and say i was paid in full. can i change the language to say: contingent upon receiving funds from final Freedom Bank Draw request?...Read More

I placed a lien for money owed. I allowed it to expire and chose not to act on it and foreclose. The building owner is threatening to sue for allowing it to remain on the record. The money is still owed. I chose to not foreclose or file for removal because I dont want to spend a single dollar more on this. Am I obligated to remove the lien ? Can i be sued?...Read More

I have a question regarding sending the Final Payment Release & Final Release of Lien for a project I finished working on. I have a subcontract agreement with a construction company, but I am not a construction company. They didn't pay in full for some of my invoices. And I need to submit this Final Payment Release & Final Release of Lien with my last Pay App for the last week of work. My last day of work on the project was 1/27/21. I am not sure if I should submit this Final Release of Lien or the Partial Release of Lien, and how many days I have to submit the Final Release of Lien. Since I never had to deal with liens before, I don't know what amount should be written in the Final Release of Lien, the final payment, or the amount they already paid me? Thank you!...Read More

We filed a lien and they have a payment for us... they want us to release the lien prior to sending the payment. My question is they are not fully satisfying the lien amount as they are still withholding the retainage amount, so if I "release it" am I able to refer back to it at a later date and say they didn't fully pay us?
