Received a Notice of Right to Lien from a subcontractor that has been hired by the "Customer" the General Contractor to supply material on a commercial property. Possibly supply labor too. The General Contractor has been hired by the Tenant, the Tenant per the lease has agreed that it shall get the Landlord's review and approval for all contractors that will be performing to the improvements of the Premises. The Tenant will not allow for any liens to be attached to the premises. At this time the Tenant has not submitted the contractor's name that we received the Notice to Lien for approval or for review as the lease states. In addition, the material that the subcontractor has listed in the Notice of Right to Lien is not an item mentioned as an improvement of the space. I'd like to know besides the posting of a non-responsibility, If I should take this a step further and send a letter in response to this notice to all three parties, (1) Tenant (2) General Contractor (3) the Subcontractor that provided the notice. The notice would state the non-responsibility and the agreed-upon terms of the lease....Read More

If I receive supplement payments and the process of getting adjusters to approve the amount a project is worth is after my lien deadlines (so I dont have an exact amount due) how do I protect my lien rights? My attorney has advised against filing the lien with a round about number because "the courts don't like that and can throw out the case". ...Read More

Hi, I have a roofing contractor installing a new roof on a property in Oregon. If I pay him 100% and he gives me a unconditional waiver/lien release upon receipt/deposit of my check, am I covered if he doesn’t pay his roofing material supplier? Is it necessary to have a supplier lien release that lists a dollar amount, or would an unconditional through a date, no dollar amounts, suffice? I would want dollar amounts from our subs, just wondering if no dollars for suppliers would offer the same protection. Sometimes we have a really hard time getting lien releases from our vendors for the correct dollar amount, as my amounts do not match their amounts. A lot of times it's due to coding the purchase to the wrong project on their end. Part of the problem is that when I submit my pay application to the GC by the 20th of the month, I don't have all of the dollars spent through the end of the month, so I have to detail what I have in my system, which doesn't always match the dollars in their system. And, you get into the coding issues as well. My GC is expecting a lien release from vendor ABC for $5,000, but the vendor shows only $3,000 got coded to the project, so they refuse to sign my lien release....Read More

my fiances boss at the time asked me to clean his office for him. He knew I had prior experience. I gave him a deeply discounted price because I knew his business was struggling, he had become boss/friend to my fiance and he was very grateful. He agreed to the price and terms of cash payment within 30 days (which I wrote on the invoices). I cleaned for him only 4 times because he never paid me. Always had excuses etc.. it has been 4 months since I first cleaned for him and he says that he paid my money( I have all this in text messages) to my fiance in pay pal transactions a little at a time. He has only paid my fiance $200 cash for over 200 hours of work that he has done. I repeatedly asked for my money and was never once told that it had been given to my fiance until now ( my fiance quit him as well for non payment). what can i do? Isn't this fraud, theft or embezzlement? when i threatened to sue him, he paid me $45 cash of the $172 bill. he has never once said work wasn't acceptable, in fact he was very happy with it....Read More
