I learned that the hiring party changed on mechanics lien that was filed in Kansas. I wanted to know, if its best/required to update the hiring party on the recording lien or should I leave it as is? The fear is that I would have to release the current lien filed after the lien deadline, is there an alternative option? ...Read More
I have a customer that I assembled a playset for.
He paid all but $130. He never argued the price but refused to pay me at the time of completion. He did not pay until 3 hours after I left the residence and then refused to answer any calls or text messages from me. He never replied or tried to call me back. After finally sending me a payment he shorted me by $130 dollars. When I requested the rest or tried to reach out to him to inquire as to why he didn't pay the full amount, he refused to answer any calls or texts. How can I get the rest of my money? ...Read More
We are the home owner and we agreed on the work to be done verbally and through pictures and discussion. The owner of the company said he sent the project list or sent it accidentally to another home owner. We continued to ask for it and he promised it would be shared. In the mean time we signed the contract to start Jan 2nd (50% down). Now he has come back with an inflated price and it doesn’t included even everything we agreed too. What to do and how to cancel the contract and get our down payment back? Thanks...Read More

We completed work on an apartment pool. The work was done well but client came back with multiple punch lists. We addressed all of there concerns and went above and beyond to ensure they were satisfied. After having outside corporate trainer visit and address concerns they notified corporate that they did not wish to continue to work with us and would only talk with product manufacturer. After making multiple efforts to move forward we eventually opted to file a lien. When we where gathering information for the lien I visited there website and found 11 pictures of completed project being used to market the apartments while they claim work was unsatisfactory. ...Read More
If the land based classification shows ownership is Federal government, but there is no bond in place (construction is public-private partnership), does the Miller Act still apply?...Read More
We sent the Notice of Intent to File on 10/21/22. Per the USPS tracking, it's been sitting in Denver and not delivered. Can we file the Mechanic's Lien if she has not received the Notice to File? She refused to give us her email address and flat out said she wasn't going to pay. I am worried that she will be selling soon, I know the home is currently for sale and I heard they have a contract that is pending....Read More
I'm a Sub contractor doing work (boring and pulling fiber) for another Sub on an AT&T project. We completed our work last month and have been unable to get the sub contractor that hired us to pay. We are currently trying to file a Mechanics lien and have submitted red-lined prints to the levelset research team, showing exactly where we preformed work but I'm being told that they cant find the exact legal description for this project, nor can they find the bond. Can you please advise as to how I'd go about finding this information or if I can file the Lien effectively without the legal description and/or bond information. ...Read More
Essentially, I made an arrangement with my sisters boyfriend. They needed money for plumbing in their home, and we needed our house finished painting.
Long story short, he never finished painting our home, and what he did paint didn’t meet the transparent directions we left for him. He also didn’t meet the deadline as clearly directed, and my husband and I delayed putting our house on the market twice because they didn’t finish in time. He has still not finished the job.
Our realator showed the house 53 times and 53 complaints, and turn offs because of the interior paint job.
We brought this to my sisters boyfriends attention, and simply asked “can you fix this?” He snapped and sent threatening, slanderous text messages, phone calls to me, my husband, realator and carpet installer. We asked him to stop, and has yet to do so. It has gone so far that he’s threatened to “fuck up our property.” We have phoned the police about this.
Our realator is the one who informed us of these calls to her and “putting a lien” on our house and bank mortgage or account. I don’t know he has stayed he’s going to get paid.
Furthermore, no one said he would not get paid, but what can my husband and I do with this particular situation? I’m afraid he’ll destroy our property, put a lien or some other Henderson e for us to be unable to sell our house. Please call me at(913) 206-2097. I look forward to hearing from you.

As the GC, we have paid our subcontractor. Our subcontractor has not paid his subcontractor and they are threatening to file liens on our customers properties. What can we do and what are the requirements? ...Read More
I have hired a general contractor to put an addition on my house. He then hired a concrete subcontractor who turned out to be a fraud. My GC paid the sub just over $13,000 in advance (he's going after him separately). The concrete supplier was given a bad check by the sub for around $5,800 and the check obviously bounced. I work in construction for an aggregate company that is a supplier to the concrete company that was given the bad check. They know I work for the aggregate company and called me at work to threaten filing a lien on my home property. Instead of letting my GC pay the bill and be done with it, they trusted sub when he said he would make payments (though he was in jail for numerous days). As of yesterday, they have sent out their notice to file lien on my property which is going to alert the Farm Service Agency who holds the loan on our house, acreage, cattle, and machinery. I have a couple questions: Can the concrete supplier actually file a lien on my property even though my GC has given them proof that the sub was paid for more than the amount of the material? It sounds like they will still be filing suit for the bad check even if my GC pays them in the next 10 days, can they actually do this? Lastly, are they allowed to track me down at work and call back in February to threaten a lien when the only reason they knew my place of employment is because of my business dealings with them?...Read More

damage was coves very common Roof is complete in August but roofing company is still working with insurance company to get the damaged walls approved in the same claim.
Walls were eventually approved but then the insured decided to keep the money instead of putting into too, .
Insurance company is dragging their heals forever on the walls because they dont want to pay. Now the customer wants to keep the last satlellite money instead, and making excuses llke he doenst have to pay us now.
Make matters worse the carrier is being impossible to get the final RCV amount because we didnt put the the same type of roof on that it had before which no carrier has ever done before. All these delays jumping through hoops has put us outside the dates to file a lien. I think, however we had a missing piece of the gutter that we had to take out last month. Does that constitute still working or what do you suggest please?
Thanks,
Kyle Roberson
