Hello, We are condo owners in museum park. We hired a design company and their recommended contractor to renovate our bathroom. It is 6 months since demolition and we cannot complete the project due to a bad design, inaccurate measures etc. The original contractor has pulled out of the project completely and the design company does not want to take accountability or help fix the problem. We cannot afford to renovate the bathroom again. I do have the contract with the designers, the original contractor never provided us with a formal contract even though they told us he would. We don't want to spend money on lawsuits but If it is a way to reclaim losses and complete the project, we would be grateful. Thank you for your time

We were subcontracted by a National Service company to provide lock repair services to a few local retail shops (~10 separate invoices totaling about $3,000). The national service company has refused to pay their invoices. Can I file a lien directly against the local retailer location? If for nothing else but to put heat on the national service company to pay their submitted invoices. This company has a track record of bilking their subcontractors. The owner has been requesting signed lien waivers, material receipts and proof of construction expenses etc. none of that is part of our (Owner / GC) agreement. 8 months and 32,500 later my 900 square foot basement is still not finished. The contract is requesting another payment of 8,500 (the original contract was for 35,000 but that was before I insisted on permits). Three weeks into the process, I insisted that permits be pulled and he said it would cost more and take more time. But is this excessive? We received the permit back in late June and he said there would be no more delays it is now early December. so far the rough inspection has cleared. I am just waiting on the village to do the final walk-through upon completion. When I asked the contract when he would be done (he just finished drywalling), he emailed he was out of money and nothing would move forward without another payment of 8500 " hopefully by Christmas but who knows what can happen in this crazy world." I feel like that was a very unprofessional answer. And how is he out of money? Where are the materials to finish the floors, bathroom is being done from scratch, where is money for that or paint? This didn't feel right. When I went to the village she said they can't take sides but I can use another contractor if I switch the permit to my name. And specify a new contractor that will register with the village. When I approached my contractor to give him one last chance he blew up at me, He emailed I owed him over 10,000 and I better have a lawyer because he will put liens on my property and have all the subcontractors do the same. This is a very intimidating situation as I am single and live alone. I had every intention of paying all, but this is getting excessive. Would you please advise me on what to do next? On June 1, 2020, Forever Clean Gutters came to give me an estimate to repair damage done to my gutters and downspouts on the entire house. The estimate came to $4,100.00. I signed the agreement. Today(11/24/2020), I received a Contractor's Claim of Lien in the mail from Forever Clean Gutters, for" services, labor, materials, equipment, and/or work provided by the claimant: 162 Ft of Gutter Guard Protection, 25 Ft Gutters, 22 Ft Downspouts & Misc. Materials." Amount of claim: $4,100.00, Contract type: Written, Date of Contract: June 1, 2020, Date of Last Furnish of Services: June 2, 2020." Then it says: Property: Services were furnished in the improvement and/or construction of real property..."
The fact is that the services were never furnished. The property remains with the damaged, hanging gutters and spouts. The property is owned by my parents, Rodolfo and Adriana Membiela, whose names appear on the Lien and are now both deceased, and I am Adriana Davis, their daughter, who took care of them them for the past 20 years at this address. BTW, I am unemployed since July 2020. What can I do in this situation???? I have a friend who owns a house and hired a contractor to do some work. The contractor did not finish the work and my friend is unwilling to fully pay him. So the contractor has put a lien on his property for the 2000.00 expected to pay. The attorney fees that the contractor has incurred is 450 and they are expecting my friend to pay the 2000 and 450. Hello, I completed a job for a client who used a 203k loan through Loan Depot. I was paid half upfront. After we finished bathroom the client signed a certificate of completion. As a condition of getting the rest of my money I had to sign a lien waiver. After checking the portal and seeing that 97% of the work was marked complete I signed away my lien rights. Immediately afterwards I received a notice from the client saying that we were being fired for not completing the job. The client will not allow my crew to assess what she claims are unfinished items even though I offered to correct whatever she felt was wrong. She decided to take it to arbitration. Her case was dismissed with prejudice. I made a mistake by not filing a counterclaim and the bank still will it release the funds. It’s been 8 months since we completed the job. The outstanding amount is around 6k. I was willing to settle for 5k. Do I have any options to collect? The check is a double signature check and the job is located in Illinois....Read More
