One of our customers isnt paying for his fence because his neighbor says the fence is on his propert. I have filed a lien and was thinking of sending this email " We’ve had to file a lien on your property because of non payment. I’ve tried calling multiple times for payment and it’s obvious that you don’t want to settle this because your neighbor threatened to send you a letter. If I don’t hear something from you and since this is a shared fence we’ll look into sending your neighbors a letter of intent also." I know filing the lien on the neighbors is illegal but could i have legal problems by just sending this email as a scare tactic? If I send this email he might pay but I bet he'll write me a bad google review and that could cost me future sales....Read More

I have been paid about 50% to date byt the remaining amount is 3 weeks past due and the client is trying to rewrite the contract to her advantage. Client stopped project, my signed contract said "If for any reason the project is stopped, the full team fees will be paid immediately". The have charged a late fee of 5% and said they would pay and now are back peddling after the invoice was sent three weeks ago. They are also terminating people or asking to negotiate. I was hired as a subcontractor to do some repairs on a home that is bank-owned to prepare it to sell. I do not have a signed contract. I do have the original quote, although it was never signed. The construction company that hired me has not made any payments for this project. I have worked for them in the past and they have paid. We placed an interior floor that is contracted to us to color and seal. The Building contractors knew that it was a finished floor and they were to take up care of it. Unfortunately they chose not to. There was some damage done to the floor therefore we were not going to be able to just color it, it was now going to require an overlayment. Obviously an overlay ment is extra cost outside of what we had contracted and estimated. The homeowner chose to bring in a 3rd unknown party To complete the color on our floor. Our contract is still open with this clients and our floor has been finished by someone else. My question is when a homeowner puts out request for bid or estimate on contracted work is that a breach of contract? If we are expecting as the contractor a certain amount of revenue and suddenly it is yanked out from underneath our feet or taken away from us.
