I keep finding conflicting information online regarding whether Iowa mechanics liens need to be notarized. The MNLR website has liens filed with and without, the Secretary of State form does not include a notary block, but the lien form provided by the Iowa State Bar Association does! I had a contractor boyfriend who was to go in business with my fix and flip company. I was forced to end the relationship due to the abuse and also refused to bring him into my business. He threatended to take everything from me and since has started the process. I am to be closing my flip investment on the 12th of this month and I use my primary residence (which is free and clear) as collateral on the down payment and then pay it back at the end of the flip. Andrew (ex) knows all of this and has placed a fictitious lien on my property. I have plenty of witnesses to stand up for what is right here (some are his friends who disagree with his antics) to prove this is false and I also have many text messages to substantiate my truth and his dishonest placement of this lien. I just lost 100K today by beig forced to cancel this fix and flip loan due to his lien placed a couple days ago. What do I do?...Read More

I was hired to work on a condo for a client. Now we are parting ways - he told me he was hiring someone else. He is not paying the invoice dated May 3rd, 2022 for work done. I have given him plenty of opportunity to pay and tried to open communication but all my attempts have been ignored. I have sent out an intent to file a lien on July 4th and he responded that he would pay $3,500 - ($6,245 is owed). Do I proceed to lien? Have I passed my time deadline? I know Iowa requires a preliminary notice of lien rights be provided to the customer before work begins or soon after. That being said, we do not have an "official form" for this; however, the fine print on our contract has a line that says the following: "Pre-Lien Notice: company hereby provides notification that any person or company supplying labor or material for this improvement to your property may file a lien against your property if that person or company is not paid for their contributions. Upon default in payment, a lien will be placed on the property and charges will be added from the date of substantial completion at the maximum rate allowed by law." I agreed to cut down 4 trees by my self,. The first one I cut down in a day, at the end of May the 28th I was only paid 100 dollars, but the whole job wasn't finish, so I didn't worry about the rest, yet cause candy the lady who's house it was, didn't have the funds yet, I said ok,. 3 to 4 weeks went by and candy. Said her pool showed up today and she wanted the rest of the trees cut down,. I said ok, I cut all three down in 1 day June 26th 2021, and cleaned up by June 27th 2021. Now before this. I was Un aware that a deal between Jake and candy that lived next door, we were neighbors, that if I cut down the trees she would give him this Indian motor cycle, and he would pay me ,. The original deal was for 300 per tree,. But since I had to wait one of them would give me 500 per tree for waiting for payday. My girlfriend's mom purchased a house that my girlfriend then rented. Her mom wanted some framing around water heater, etc done in basement and also wanted a deck built. Many text messages to prove that she asked for these things but no contract. Her mom was also there in person for some of the deck construction. Payment was never discussed. Her mother purchased most deck materials but not all. Now her mom suddenly wants to sell the house and has already had realtor pictures taken. I wrote a check for the amount I believe correct with the note on the memo line In Full Contract no. XXXXX.
