We are a wholesale company located in GA and supplied material to our customer who now owes us money for the material. He apparently was contracted to do a job in TN and the contractor/owner is out of Illinois and he is now asking our company to sign the below Illinois lien waiver. We do not feel comfortable doing so but, he is telling us it is needed in order for us to get paid and that the company that contracted him is going to be paying us with a check made payable to us and to his company. Please tell me i am correct in NOT signing this. Sir- We had big tornado in Naperville IL area last summer (summer of 2021). Lot of houses around us were damaged. Many storm chasers were knocking at our door. A particular company Home Pro Restoration sales agent knocked as well. I verbally negotiated and said I won't pay any additional payment from out of pocket- whatever is covered by the insurance company is what Home Pro will get, I also mentioned that I'll pick home pro over other only if Skylights will be part of the replacement cost. The company went through 2 re inspection process and managed to get $21,900 (in estimate) from our insurance (All State) and in addition charged us $2,320 for skylights. We verbally disputed the added charge of $2,320 and tried to converse and mention that this was never agreed upon in writing. We signed the first dispatched check of $15K but did NOT endorse the second and third dispatched check of approximately $1,700 and approximately $4,000 and asked the Home Pro guys that we'll endorse if you take out the $2,320 charge. The Home Pro sent us a letter from their attorney asking to endorse the remainder checks (which we have all intention of doing) and pay out of pocket $2,320 (which we don't think we are liable to pay). I called their attorney office once and the conversation was good but then I got the call back within an hour from the same attorney and he was extremely abusive in his tone on my regular conversation and he threatened to do lawsuit on me and put an immediate lien on my property. I would like to stop the lien against my property without paying the out of pocket expense. Could you please advice? Thanks a lot for your guidance....Read More

I have built a home and the contractor gave me an extra bill for work he said he did throughout the 12 months of building my home. I had a 6 month contract which states he has to provide estimates up front for any extra work that he would do to the property that must be signed off by both parties. He took liberties throughout the project of dragging his feet over a whole year, lost labor, ordered materials only when he needed them instead of all up front and this caused numerous delays holding up my build for a complete year and it still is unfinished. He refuses to provide me with a breakdown of the extra work he did and just lumped it all into one lump sum bill. Some of the items he was under contract for he included in this lump sum. How am I supposed to know what he was working on under contract or extra stuff he claims? Is there an Illinois law that requires him to provide me with breakdown or will my contract suffice with legal rep to hold him accountable?...Read More

We supplied material to a state agency governed by the county. They short paid our bills and will not pay the difference. They had no valid reason. We sent them certified letters and told them we intend to lien. We just want to send notices out. We were told we could file a claim on the bond. As far as I know, there is no bond. They purchased directly from us and we supplied the material directly to them. There is no general contractor involved and they did not supply us a bond. Our customer was renting our equipment for work that he was doing as a sub-contractor on a construction site and significantly damaged the rental equipment. Per the rental agreement, the customer is responsible for 1. rent while the equipment is being repaired 2. loss of value of the equipment due to the damages 3. Repair cost to repair the damages. The customer hasn't paid any of these 3 components. So how do I find out what classification for prevailing wage rates I would under for jobs? Is it in the contracts and that’s what I would fall under? Like for instance I believe my work has us as laborers under contract for the work but then pays us as sign hangers in cook and lake county because it is less.
